Hello. Sino po may same case sa inyo kagaya ng husband ko? Nag declare po sya dependent and nag send na email ang CIC na need mg medical bata. His ex wife has custody and we tried convincing her to let her daughter undergo the medical exam and explained to her na required lng CIC kse nga considered dependent basta anak. We told her we cannot take their daughter without her consent and we are just keeping their daughter's options in the future lalo pg lumaki sya pero she does not want to cooperate. She said sya lng pede mag declare na dependent sa bata and that law applies internationally daw. We even sent her links of the CIC website pero she is still not convinced unfortunately . Na document nmin lahat conversations nila sa email na na send nmin sa CIC and attached those as proof. It has been 36 days since we emailed it pero wala pa din reply from CIC. Naka in progress na ang Background Check hubby sa account nya. I am just wondering what to expect from CIC in cases like this. Thank you.

I submitted in March to sponsor my wife. Now its November, the immigration came back to me (this is the second time) requesting more evidence to establish my intention to re-establish in Canada. They say what I've provided is not enough. Super stressed.......

Anyone got any advice on this?

Hi we have similar case, let her sign affidavit letter that both parents are aware if their daughter does not undergo medical exam he will no longer be able to sponsor her in the future and he has tried his best to convince her. Whats your timeline?

Natagalan ba bago ng reply CIC sayo? Kse it has been 36 days since they acknowledged receipt of his email pero he still has not heard back anything. Here's my hubby's application timeline:

Application sent: May 16, 2016
AOR1: June 2016
AOR: July 20, 2016
Additional docs request: sent Oct 7, 2016
Request for non accompanying dependent's medical - Oct 7, 2016
Emailed CIC abt dependent's medical: Oct 20, 2016

Lat resort po yang option na yan. Need talaga ma convinced ang officer na ginawa mo na lahat ng makakaya mo para maipamedical ung Non-accompanying dependent. Kung wala namang court decision ung xwife na granted sa kanya ung sole custody ng bata, pwede mong dalin sa court at kumuha ng court order na ipapamedical lang at walang masamang intention.

Nakaka-frustrate ung issue na ganito, like ung akin May 2016 nag request ng medical ang VO. Na send ko na lahat ng conversation namin ng xwife ko sa VO pero nagmatigas ng halos 6 months kaya tumagal ng husto, to the point na nagpadala na sakin ang VO ng procedural fairness letter regarding sa medical na pwede ma refused ang application ko kasi inadmissible ung non-accompanying dependent ko. Buti nalang talaga napapayag mo na mag medical. Namedical na ung dependent ko eto lang Nov 22, soon after that naka received nko ng additional Docs na NBI kasi expired na ung naunang NBI ko. Sana PPR na kasunod.

I agree the journey has not been easy. Can I ask if you have joint custody of the child? Kse in my hubby's case, his ex-wife has sole custody. Thank you.

Yes mam sole custody ng wife ko, kasi yun din ang decision after ng annulment visitation rights lang ang na-grant sakin.

May I ask mam kung my decision ba na sa ex-wife nya ang sole custody?

Hi avgamiao, I responded to your post earlier sa kabilang thread. Just thought you might still like to read it :) Here it is nweis:

Sorry to hear about your case (or that of your husband). I doubt that you will get a direct response from CIC or the visa office. You have responded to what they asked. Since the Background, as you mentioned, is already showing "In progress", the VO is in fact, continuously processing the application which is a good sign. You have sent them all the proofs that you have that the mother of the child is pretty obvious will not cooperate. Let's hope and pray that the VO will be convinced (to which I am sure they will). Just be prepared though, that your husband might get something from them for him to sign or for him to confirm and agree that he will NOT AT ALL be able to sponsor his child in the future. In any case, you both should keep all the evidence that you have so that if and when the time comes and his child is grown up or something happens to the mother, that his child will then know the reason/s why he cannot sponsor him/her.

Yup. Nakalagay sa court decision sa annulment din nila na ex-wife nya ang may sole custody and visitation rights lang sya. I think loophole nga to sa law ng immigration. The dependent is not coming to Canada and they will require that dependent to undergo medical exam in the future anyway if the dependent applies for permanent residency. So why is it important to undergo the medical exam now is beyond me.
