Q12: What exactly does "in process" mean?

A12: "In process" is the status given to any application that has been received at a case processing centre or a visa office but that has not yet been finalized. Therefore, for the duration of the Application Processing Time, CAS will show the status as "in process."

Hey guys,

When I saw this, I was nearly in tears. Should I really be panicking?

I checked out our application status online today. This is what it said:

Received our application - Oct 27, 2011.
Approved my application to sponsor my husband - Jan 24, 2012
Started processing application - JULY 14, 2012???!!!!

What the heck?! Does that mean from July 14, 2012 we have to wait another 6-18 months to get his visa??? I'm gonna die!!!!!!

Chances are they started processing your application before they updated your ecase online. This happens to a lot of people. Don't worry! The time started from when the app was transfered not when ecase changed. :)

I have a situation where I had applied for my spouse visitor visa and which got rejected. when we applied for visitor visa, we got reference letter from a friend of ours. This time, as I am in canada, working here, can I sponsor my spouse instead of any friends/ relatives. Whose reference letter of invitation would be good for visitor visa? Is visitor visa same as TRV?

Another question; when the spousal PR is in process, can the applicant get a work permit? My spouse can get internal transfer (thru work permit) but it might take 3-6 months to be effective. In the meantime, can we apply for a spousal sponsorship? Would spousal sponsorship affect work permit???

You can certainly try - why did they reject it last time? The biggest problem with spousal TRVs is usually convincing CIC that the TRV holder will leave at the end of the temporary visit period.

Yes, dual intent includes spousal sponsorship cases.

It does not overcome questions a VO might have about whether or not the applicant will leave at the end of the temporary residency.

I am writing to seek some information about the conjugal/common-law relationship immigration process.

I am planning to get my partner on a visitor visa to Canada. She is in Pakistan, but her divorce case is still ongoing in Pakistan. It has been close to 10 years that her case is ongoing. And she is finding it very hard to sort this case in her country because of slow court proceedings and the difficulty of getting divorce for a woman. She lived in her married relation for only 3 months and unfortunately her case has continued for 10 years.

I have been in relation with her since the beginning of this year (in Jan). A few questions:

1. If I get her here in Canada on a visitor visa, can I apply for her permanent residence in the conjugal relationship category?
2. What documents she needs to bring to support the immigration application?
3. Can I apply for her divorce in Canada while she is on a visitor visa?
4. For common law partnership we need 1 year cohabit period, our time together will not aggregate to 1 year because I have lived with her during my visits to Pakistan. Can I be eligible to apply under common-law this category or any other options?

Please if you can advise. Looking forward to hearing from you.

My husband has Parkinson disease. I am panning to apply for sponsorship next month. So is Parkinson disease any problem for Canadian immigration? Because i heard that in case of spouse/children sponsor visa CICA is not to strict. Can any body confirm Parkinson problem? Thanks

You are specifically concerned about "medical inadmissibility due to excessive demand". This is grounds for rejecting applications in economic classes and some family classes but it does not apply to spouses and dependent children.

Thus, Parkinson disease is not grounds for refusing your husband's application.

With that said, note that anyone with a medical condition should be prepared for a longer-than-normal application time.

thanks for your reply.If CICA accept medical inadmissibility due to excessive demands on spousal/family relationship.So they case should go on a regular procedure.why should they take extra time or your r just guessing that they might take extra time on those cases? :)

Anything out of the ordinary seems to require additional review.

For example, even though serious medical conditions are not grounds for exemption, some visa officers interpret one of the manuals to mean that the sponsor must be advised of the serious medical condition and given an opportunity to withdraw their sponsorship. So one thing I would suggest that you do up front is acknowledge you know of your spouse's medical condition and are submitting your sponsorship knowingly. That MIGHT head off further inquiry and a couple additional months of delay.

Perhaps you'll be fine and there won't be any delay, one cannot really tell with CIC.

Hello Guys,
I have a few questions regarding family sponsorship, can some one here please help me replying...
I am currently a Canadian PR since Nov 2011, I am planning to get married in Nov 2012 in India, my spouse is currently on a work visa in usa and we are getting married in India and she be returning back to USA until she gets her Canadian PR.

How do I start my Process is it from Canada or India or USA?
Will the PR 2nd stage application go to India or USA , I am worried as she is currently in USA and processing time is more in states compared to India.
Are there any tips before getting married that can speed up my process as I will be visiting India for marriage only 2 weeks.
