I would like to ask for a help. My mom applied as a refugee on 2008 but it was denied but stayed. She got married and applied for permanent residence visa through spousal sponsorship. She was "deported" in Canada on June 2013. She went home unescorted and paid for her own plane ticket.
now, the immigration sent us this:
Re: Your request for authorization to return to Canada
According to paragraph 52 (1) of the Immigration and Refugee Protection Act, any person deported from Canada cannot return without authorization.
In order to request this authorization, you must complete the attached application form and provide the following:
• a photocopy of the identification pages of your passport
• two identical passport-size photos (scanned or photocopies photos not accepted)
• all documentation related to your deportation
• a letter explaining the circumstances which led to your deportation and the reasons for which you now wish to be admitted to Canada
• processing fee of $400 CAD per person.
• The processing fee is not refundable, even if the application is refused. Please find attached our instructions for fee payment.
If an interview is necessary, you will be informed.
The decision to grant an authorization to return to Canada is made only following an evaluation of all the factors related to the deportation and the actual situation of the applicant. At this point, we cannot guarantee that your application will be accepted. A deportation order is issued only when a person has made a serious violation of the Immigration Act.
In the case where a person has been deported by reason of criminal inadmissibility, the applicant must, except in exceptional circumstances, prove that he has been rehabilitated and is no longer inadmissible. If the crimes were committed in Canada, he must demonstrate that he has obtained a pardon from Canadian judicial authorities. This pardon, or rehabilitation, does not constitute a guarantee that an Authorization to Return will be issued.
The information, document(s) and fees we have requested must be submitted to our office within thirty (30) days from the date of this letter. Failure to provide the information, documents and fees within the time indicated will result in the refusal of your application.
As we read the email sent to us by the immigration, the is no attached application form. I also tried to look one in Canadian Immigration website but failed. Can you please help or advise what should my mom do? We also sent email to canada immigration telling them that they might have missed out to attach the application form. I hope someone can help me regarding this.
