Hi legalfalcon, you can see my time line in my signature and also my notes's result,My BG check is in progress since June 30,and according to my gcms notes my assignment application due date was 11 November but didn't hear anything in due date.So what do you think my bg check again goes to not needed at this time and in progress again before PPR?
Any advice
As per my experience the due date is just a system generated date which has no bearing on the applications. For some applicants the due date is way ahead in the future and they end up getting a PPR before that, for others the due date passes with no significant movement on their application. I would suggest that you just ignore it.

As regards the BGC in the recents months there has been a trend where the BGC goes in progress and then to not needed before going back in progress a few months or weeks later. Why this happens is just speculation and there is no specific trend behind it. So if your BGC went in progress, and given that your R10 and A11.2 is cleared, then there is a likelihood that your BGC has in fact started.

Hi Legalfalcon
I am in process of filing my application for PR. I have couple of questions if you can help me with please.
1. My wife has foreign work experience in which she is not eligible for points on CRS. I still included her experience in the EE profile and got the documents checklist generated, however I found difficulty finding NOC that matches what she does, so put the closest. Do you think there will be risk of rejection if her duties don't match the NOC although she is not the primary applicant and I haven't claimed points for the experience? what do you advise?
Since your wife's experience is not being counted and there are no points being allocated for it, there would be no examination for it. However, it is still prudent to get the closest possible NOC for your wife's experience. It would not be a bad idea to add a LoE just in case describing that given the work your wife did, it does not fit in a specific NOC and what you have mentioned in the file is based on your best judgment. But there is nothing to worry since it does not count towards the eligibility of your application i.e. A11.2.

2. My wife was born in Venezuela, she lived there when she was below 18 years, turn 18 there but left 4 months after that she left and never been there again. Although IRCC website, clearly says PCC are required for countries lived in for more than 6 months since age of 18, this is a unique case I believe. So she lived there for more than 6 months, but only 4 months since age of 18. Now, I am trying to get PCC from there, but it seems to be impossible. Do you think it will be required with the application?

The requirement states that an applicant needs a PCC from "each country or territory where [the applicant] has spent six or more months since the age of 18." So technically speaking, your wife, since she did not spend more than six months after she turned 18 and left the country will need not submit the PCC for Venezuela. However, given that she was born in Venezuela and lived there until she was 18 and a few extra months, it would be better that you submit the PCC if you can easily get one. It may be possible that at a later date the IRCC may ask for the Venezuela PCC which will unnecessarily delay your processing. Though you are right in not furnishing it, but when its a close call, I also advise to send the documents as it does not hurt.

3. For my degrees, I have Masters with ECA. Do I need to upload the Bachelor and high school as well?
In your ECA did you get your bachelor's evaluated or just your Master's. If you ECA had all your education after high school, which should be done, then you need not upload any certificates. But if your did not get your bachelors evaluated, then its will be advisable to submit your bachelors to be on the safer side. However, it won't matter much since the CIC relies on the ECA reports and not what an individual applicants submitted.

Thanks and Regards,
Hope this helps!

Thank you Legalfalcon. That is extremely helpful specially for the wife experience as this is what worries me! I am still trying to get the PCC fingers crossed!

For my degrees, I got ECA ONLY for my Masters, not the Bachelor. Is that fine, or Bachelor is a must? What about my high school, are these needed also?

Dear Legalfalcon,

Is it mandatory to file schedule 4 along with ITA for a PNP applicant.

I have not filed it but yes I have forwarded my nomination certificate along with me LOE. would that suffice or will they send request for additional documents to me.

Thanks and regards
As rule of thumb Schedule 4 is requested from all PNP applicants. Usually after filing the application CIC will request for a Schedule 4. Once you get a request you will have a place to upload the Schedule 4. How long ago did you file your application?

Yes, that is fine. Usually only the highest degree is counted and as long as your have the ECA for it, that works well. But since you are paying for the services anyway, I always recommend getting the ECA for all education after high school. But in your case you are good. Just upload your bachelors degree certificate to be on the safer side. Even though it may not count at all, but does make your file look complete and in case of any concerns, the certificate is there.

Hope this answers your question.

That answers. Thank you. I am in relief now.
I saw on another post that Schedule 4 is needed for all PNP, what is this? where do I get it and how do I submit it?
when I was nominated by NS, I received email stating that NSPN office confirmed with IRCC the original nomination certificate is no longer required. Instead they sent me a letter that I will have to send along with my PR application.

I wanted to know the date to find how long it has been since you filed your application. You recently filed your application, rather a few days ago. Nothing to be concerned about. If you did not have a place to upload the Sch. 4 when you uploaded the file, you will get an email or a communication on My CIC requesting you to upload one and that is when you will have to do it. This is the normal procedure for everyone and it does not delay your application and neither is it a ground for refusal.

Just wait to hear from the CIC.

I didn't see this for a while, just came across this. I hope everything is sorted out and I am always happy to help.

Good evening,

I have an issue with my immigration process, and I was advised to ask you.

I am a Palestinian Refugee living in Egypt and my legal status in Egypt is based on a Travel Document for Palestinian Refugees issued by Egyptian government. However, I also have my regular valid Palestinian passport issue by Palestinian Authority. Few days ago, I received ITA, and I am preparing to apply by mid December.

My questions are:

1. Which document should I base my entire eAPR application on?
2. Should I show up the two documents?
3. Should I mention what is my legal status in Egypt by anyhow, and would it cause a problem to show up the travel document on which my residence is stamped?
4. Does it matter for CANADA to have both; Regular Passport and Travel Document as well?
5. My police certificate in Egypt is issued upon my Travel Document, so I have to show it up.
6. Can I apply with such a case from the beginning?

Note: I am not a refugee claimant to Canada, only to Egypt.
Kindly help me to figure out what exactly should I do to proceed with ITA.

Best Regards,

Best Regards,
I understand your problem and this would be my advise. But you should also consult other members who are knowledgeable in this area. Here is what I would suggest:

1. Which document should I base my entire eAPR application on?
You should apply based on your current passport issued by the Palestinian Authority. This is because IRCC may be reluctant to issue you an immigration visa on a travel document. Usually a travel document is for exiting and re-entering the country which has issued the travel document. Further, some countries may be reluctant to recognize your travel document issued from Egypt stating that you are a Palestine refugee. This is because not all countries see Palestine as Egypt or another country would. Canada does recognize Palestine, but its recognition is not clear. So it might not agree to you being a refugee, but thy will surely recognize your Palestine Passport. This is Canada's position on Palestine:

Canada recognizes the Palestinian right to self-determination and supports the creation of a sovereign, independent, viable, democratic and territorially contiguous Palestinian state, as part of a comprehensive, just and lasting peace settlement.

Canada recognizes the Palestinian Authority (PA) as the governmental entity in the West Bank and Gaza. Canada also recognizes the Palestine Liberation Organization (PLO) as the principal representative of the Palestinian people Canada continues to support Palestinian President Mahmoud Abbas and is working with the government led by Prime Minister Rami Hamdallah in terms of much needed reform.

Working with its partners and through the United Nations, its agencies and other organizations, Canada continues to support and respond to the humanitarian and development needs of the Palestinian people. At the Paris Donors Conference in December 2007, Canada announced a commitment of $300 million over 5 years towards improving Palestinian security, governance and prosperity.

<http://www.international.gc.ca/name-anmo/peace_process-processus_paix/canadian_policy-politique_canadienne.aspx?lang=eng>

2. Should I show up the two documents?
Yes, you will need to show both the documents as you are living in a country of which you are not a citizen. You will be asked to show your legal status in Egypt, and your legal status in Egypt is based on your Travel Document for Palestinian Refugees issued by Egyptian government. So you cannot hide it and you should not.

3. Should I mention what is my legal status in Egypt by anyhow, and would it cause a problem to show up the travel document on which my residence is stamped?
Yes, absolutely you should disclose your legal status. If you try to hide it you will have to misrepresent on the application and that will be a ground of inadmissibility. Just remember, when an application for immigration is evaluated your legal status does not matter much as you have an intention to move to Canada permanently. Had you been applying for a visitor visa it could have been an issue as it would have been difficult for you to show your connection with your home country and the fact that you have claimed a refugee status will make you a big risk person who would not return and overstay. But in an immigration application that would not be the case. I would also recommend that with your application you should file a letter of explanation in which you can give the details of when you applied for a refugee status with Egypt, if you have any documentation for that, please include that too. I feel that it would strengthen your case for immigration.

CONCERN - My only concern is that a travel document is issued to a refugee by the state in which she or he currently resides allowing them to travel outside that state and to return. This is because refugees are unlikely to be able to obtain passports from their state of nationality. But in your case you do have a passport. I am not sure if you can get your passport renewed after you claimed a refugee status as many countries refuse to renew the passport when their citizen has claimed a refugee status, especially based upon human rights violation. Under these circumstances it becomes all the more necessary to include well drafted Letter of Explanation giving details. Since I am not privy to your case, but many refugees use their passport to travel to another country as a tourist and then upon arriving they claim a refugee status. You should explain your case in your LoE.

4. Does it matter for CANADA to have both; Regular Passport and Travel Document as well?
All countries will have to recognize the passport under the International law, but as explained above you having both, the Passport and a Travel Document will be a concern, but I am not privy to your case and don't know under what circumstances did you come to Egypt. If you entered Egypt and Egypt has a policy of granting refugee status to all Palestine subjects upon application it will not be a difficult. Also, when was the last that you got your passport issued or renewed. If you got it issued or renewed in Egypt, you will have to explain.

It is not a major issue, but you will need to give the details and paperwork to support. CIC may ask you for more documents later in the application cycle, but if you submit them upfront, that would be a good idea.

5. My police certificate in Egypt is issued upon my Travel Document, so I have to show it up.
As discussed above, you should not hide it and there is nothing wrong to have both the documents as long as you can justify and support it.

6. Can I apply with such a case from the beginning?
I don't understand this question. Could you please elaborate.

I would request you to keep in touch with me and let me know what is going on in your application. Your case will be able to help many others in your situation.

If you need help drafting your LoE, I would be happy to look at your documents (LoE) and suggest changes, time permitting.

I hope this is helpful. If you need my personal e-mail id, send me a PM and I will be happy to communicate with you there.

Yes, you only need to show and provide documents for the experience you are claiming points for. So yes you can just provide details and reference letter for your experience with Company B.

You should and this would be fine.
