Hi Legalfalcon
I am in process of filing my application for PR. I have couple of questions if you can help me with please.
1. My wife has foreign work experience in which she is not eligible for points on CRS. I still included her experience in the EE profile and got the documents checklist generated, however I found difficulty finding NOC that matches what she does, so put the closest. Do you think there will be risk of rejection if her duties don't match the NOC although she is not the primary applicant and I haven't claimed points for the experience? what do you advise?
Since your wife's experience is not being counted and there are no points being allocated for it, there would be no examination for it. However, it is still prudent to get the closest possible NOC for your wife's experience. It would not be a bad idea to add a LoE just in case describing that given the work your wife did, it does not fit in a specific NOC and what you have mentioned in the file is based on your best judgment. But there is nothing to worry since it does not count towards the eligibility of your application i.e. A11.2.
2. My wife was born in Venezuela, she lived there when she was below 18 years, turn 18 there but left 4 months after that she left and never been there again. Although IRCC website, clearly says PCC are required for countries lived in for more than 6 months since age of 18, this is a unique case I believe. So she lived there for more than 6 months, but only 4 months since age of 18. Now, I am trying to get PCC from there, but it seems to be impossible. Do you think it will be required with the application?
The requirement states that an applicant needs a PCC from "each country or territory where [the applicant] has spent six or more months since the age of 18." So technically speaking, your wife, since she did not spend more than six months after she turned 18 and left the country will need not submit the PCC for Venezuela. However, given that she was born in Venezuela and lived there until she was 18 and a few extra months, it would be better that you submit the PCC if you can easily get one. It may be possible that at a later date the IRCC may ask for the Venezuela PCC which will unnecessarily delay your processing. Though you are right in not furnishing it, but when its a close call, I also advise to send the documents as it does not hurt.
3. For my degrees, I have Masters with ECA. Do I need to upload the Bachelor and high school as well?
In your ECA did you get your bachelor's evaluated or just your Master's. If you ECA had all your education after high school, which should be done, then you need not upload any certificates. But if your did not get your bachelors evaluated, then its will be advisable to submit your bachelors to be on the safer side. However, it won't matter much since the CIC relies on the ECA reports and not what an individual applicants submitted.
Thanks and Regards,
