Right. So CIC will base everything off the date when the application is received to sponsor his new spouse (the application received date is for the new application to bring his new spouse to Canada, not the old application that brought him here). Since that application would obviously be received after the date the new rule came into play - the rule applies. This discussion seems to come up every few months. About six months ago someone even tried to apply saying that the rule didn't apply to them (for the same reasons the OP here believes they don't apply to him). They were refused (didn't even pass SA) and CIC told them the 5 year bar does in fact applies to them. Having said that - the OP is obviously free to try.

Ah...So the 2012 date, when the policy was enacted, pertains to the date when new sponsorship applications are received for sponsorship...not the date of when that [sponsor's] application for PR was received.

Hi, I'm new to this forum. My wife is applying for spousal sponsorship to me, she's been in canada since february of 2011, and we just got married last year.. she's already a permanent resident.. I have some few questions regarding the IMM 0008 Generic Application form in Canada, my questions may have been answered already but there more than 1k pages in this topic now..so...

1. Is permanent resident card considered a national Identity Document?
2. In number of years of education, should I count the year or the school year?
Example: Year School Year
2004-2005 = 1st yr
2005-2006 = 2nd yr
2006-2007 = 3rd yr
2007-2008 = 4th yr

starting from 2004-2008 that would be a total of 5 years, school year will be equal to just 4

Also, I need some clarifications if I also need to fill out the form 3911e. I'm currently working here in Qatar, not a citizen, just a working visa, i've been here since 2011.

Hi Team

I've a question regarding spousal medical. If there are dependent kids included in the application with spouse (3 years and 2 years old) couple's own kids, do they have to go through the medical exam as well? I am talking about upfront medical?

I need an answer to this soon please! I am currently in Canada with working holiday visa (IEC). I can't extend it. But I have called to CIC twice and they have told I can apply new OWP with PR and I will get Implied Status because of it. I just don't know anymore what to believe!

I'm going to apply PR and OWP at same time (in Canada class). When I apply PR under Sponsorship program, do it already give me Implied Status?
Or do I also need to apply a visitor visa?
I don't work right now so having no valid work permit for a while is not an issue. I only want to know how to be legally in Canada while waiting answer about Sponsorship program? Having IEC visa seem to be huge problem :-[

CIC Help Desk can only answer the most basic questions. This, unfortunately, is not a basic question. There is no implied status for IECs. You need to go the visitor visa route and stop working as soon as your IEC expires.

This really is crazy. There have been so many people here stuck in the same spot and were given the same conflicting information.

The ONLY thing that gives a person Implied Status, is by including an OWP or Study Permit with the Inland application, or applying to extend your visitor status anytime prior to the date that it expires. An Inland application alone does NOT give someone Implied Status.

Most people choose to play it safe and stop working until they receive the OWP, while others `roll the dice' and hope that they don't get into hot water with CIC and/or CBSA for being found to have worked illegally.

If an OWP and Inland application are received by CIC before the legal status expires and (this is the important part) neither one is returned because of an outdated form, missing signature(s), or incorrect amount paid for the OWP, the person will have a legal status to remain in Canada.

Thank you! So if I do like I have planned (send PR and OWP application in Canada Class), I will have a legal status to stay in Canada? Even I'm here now with IEC visa, it doesn't effect to it? Because I don't extend IEC, I apply for new Open Work Permit with PR.
There is three month time before my current visa expires so I believe they will receive it before it.

They also go through the medical examination but only urinalysis. They are exempted from blood tests and X- Ray. our 5 yr old underwent this. i guess they fall in the same age bracket.
