Hi

Person A came to Canada on PR in 2013 as dependent child of his parents. He was engaged since 2012, he went back to home country to get married with same person he was engaged with and lived there for couple of years, he is now back and wants to sponsor his spouse :

Now the question is

Could CIC raise the issue that why didn't you tell us that you were engaged at the time of your landing? (He said he was single on all his forms and in landing interview because there wan't any section for engagement on any form.)

there should be no issues whatsoever . you got married after you landed not before , so you are ok , CIC doesn't give engagement ( Fiancée ) any importance as long as it's not a common-law living or registered marriage .

Hi all, so my case is a little different...

I'm Canadian but have been living in Mexico for about 13 years, because I fell in love here, got married and now have two kids. Now we all want to move to Canada. My kids obviously have the right to citizenship, and our challenge is to get permanent residence for my wife. Our plan is to get her a visitor's visa, for me to get a job once we're in Canada, become her sponsor and hopefully attain permanent residence through family sponsorship. My question is: Once I get a job, can I apply for sponsorship AND her PR at the same time? And can she stay with me in Canada while waiting for a reply? if not, do you have any suggestions? I have read all the requisites for proving that a couple is married and in cohabitation, and doesn't make sense for me to go to Canada first, apply for sponsorship and wait maybe two or three years before living together again. Plus, we have kids, so we all need to be together, right? I will greatly appreciate your comments!

Hi ,
You can apply while you are in Mexico and Yes you have to apply for both to sponsor her and her PR at the same time . you will need to provide proof of intention to reside in Canada after she gets her PR .

You can also try to get her a Visa and then apply for inland which will take a very long time to be finalized .

your best bet is to apply now from Mexico while you are in Mexico and provide solid proof or intention to come back and live in Canada . like a job offer , lease , purchase of a business etc .

approved as sponsor Dec 31st 2015
application received by Mexico office Feb 16 2016
March 29th 2016 immigration requested 490$ fee for the permanent resident fee which I paid today

What stage am I at what is next and how long any opinions please thanks guys

I was wondering if anyone could help me. I applied to sponsor my wife (a Mexican) with an inland application on November 18 2015. We still haven't heard anything back from them. I have tried to look up the status using the online tool but it told me it couldn't find the application because it was not being processed yet. I was wondering what I should do ? Also if anyone knows if they are still approving open work permit applications submitted with a family sponsorship application. Also is it possible to see the 2 stages of the processing time for an application? Thank you very much

Hi everyone!

I wanted to know about the Police Certificates and Clearances + Proof of Medical Examination part of the Sponsorship. My fiancé is from Serbia and I am looking at the country specific instructions.

Am I really suppose to obtain police clearances and medical exams for EACH member of his family (his sister, Mother, brother-in law, etc)?

I do not plan on sponsoring them ever and neither does my fiancé. I thought that the medical and police clearance would only be about the spouse or anyone else that is actually being included in the application...?

Any help would be amazing. I have been unsure about this part of the document checklist since I read it!

Thanks for the suggestions! Ok, so you said it takes a long time inland.... If we did it from here, how long would it take, supposing I sent all the right documents to apply for sponsorship and PR?

I have seen people from Mexico in this forum landed in about 10 to 12 months ,CIC is saying applications could take up to 17 months .

You cannot be sponsored as a spouse, a common-law partner or a conjugal partner if:

"you have lived apart from your sponsor for at least one year, and either you or your sponsor are the common-law or conjugal partner of another person"

I got married to my wife in January and now preparing to sponsor her.

I think this means basically if you are separated from your spouse for a year or more and either you or your spouse have another partner, you can't be sponsored. Which I don't really understand because if you have another partner, then you don't have a genuine marriage to begin with.

Key word in there being "AND", as in you must meet BOTH conditions.

There's a couple ways you can go. Mexico can be a fast office for some people, if you have a solid application and don't need an interview. Since you've lived in Mexico for 13 years with your wife and have 2 kids this should be a breeze. Just do a good job on the application. Then, apply outland while in Mexico (as TanMex said, be sure to provide proof you plan to move to Canada). If you apply soon, she will probably have her visa before the end of the year.

If you really want to move to Canada asap, it might be tricky. You could try for the visitor visa right away. Have a solid plan for why you want to visit Canada (like visiting your family) Show all the ties you have to Mexico (job, house etc). I'm not sure how hard it is for a Mexican to get a visit visa, but generally getting a visitor's visa is tough. The issue here is the border, you don't want it to look like you are moving to Canada. Once you get her into Canada, you can apply for an inland application.
The downside here is inland takes about 2 years to process. But, she can apply for the open work permit then live in Canada legally for the whole process.
