Hello!

I am sponsoring my husband and I would like to ask you if by any chance you have an idea whether CIC investigates if the person to be sponsored pays his healthcare and social insurance regularly? Thanks a lot for your help!
Nope. They just want to make sure they will be able to contribute here by making sure they know English/French (or willing to learn), higher education, not a criminal and don't have any highly contagious diseases :) (These are just some, not all)

If you get married before you land with your PR visa, your PR visa becomes invalid because you now have a spouse that was not declared on your application. You would have to return the visa to the visa office and ask to add your spouse to your application. The visa office would then have to process background checks for your spouse and do medicals and eventually would issue visas for both of you.

The other option is to land with your PR visa before you get married. In that case, you must go and land, come back and get married and then go back to Canada to file an application to sponsor your spouse for PR. As a PR, you must be living in Canada during the sponsorship process. If you try to file for sponsorship and then go back to your home country to live with your spouse, if immigration finds out where you are, they will cancel your application.

Leon's answer was absolutely correct, but I want to quash one mistake I've seen people make.

If you get married and then land in Canada without declaring your spouse, you will not be allowed to sponsor your spouse, ever. This also applies even if you have just been living together for one year or more prior to landing - this is known as a "common law relationship" and is equal to being married in the eyes of CIC.

I just wanted to know if some of the forms are not applicable for example for me IMM 5476 do I still include it in the papers? or just write on the checklist it is not applicable?

Or do I include it and say this form is Not applicable? thank you

My first application (June 2009) was skilled worker. I was denied on the grounds of medical inadmissibility. I challenged the decision in Federal Court (January 2012) and was granted leave (meaning the Court agreed to hear my case, July 2012) with a hearing scheduled for October 2012. I had met someone here in late 2008 and in the ensuing years we decided to marry (May 2011). I really hadn't expected a refusal, but after the refusal my spouse and I agreed to submit a second application (March 2012) as a sponsored spouse. In September 2012 CIC agreed to grant my second application and I agreed to dismiss my JR application. My theory is that CIC was encouraged to dispose of my second application because their attorney thought it was quite likely that I would win the JR application (that was my conclusion from reading the relevant case law).

I received my PPR the same day that I dismissed my JR application (26 September 2012).

So yes, I became a permanent resident on October 13, 2012 (as it shows in my timeline).

We're going to have to apply to extend my husband's visitors visa soon.

Are we able to do it online (ie. is there a spot where we can attach a scanned document, which in our case would be a copy of the receipt that we've paid the PR fees) or do we have to print it out and send it by mail?

Thanks!

No. You must have a work permit to work in Canada as a foreign national. Once you are a PR, you may work in Canada without a work permit.

Re: Spousal sponsorship - inland on visitor visa (6months) - possible?

Leon said:
If you apply inland, you should send the visit visa extension along with your application package so you don't get out of status in case your processing takes a bit longer.

For the open work permit, use the change of status form for a temporary worker. You can find that here: http://www.cic.gc.ca/english/information/applications/extend-worker.asp If you send it with your application package, you can get your open work permit as soon as you get 1st stage approval. If you don't, you have to wait until you get 1st stage approval and then apply for the open work permit.
using IMM 5710 We are trying to fill out the OWP but it won't validate without putting in Employer info that we do not have... think it is okay to write N/A?.. or unknown ?
