My family and I migrated to Canada in May 2008. My wife and kids started to stay permanently in Canada in July 2009. She filed for separation and divorce in May'10 and now she wants support on basis on any family class immigration or sponsorship agreement. I do not remember if I signed any such sponsorship agreement in 2006 or 2007. Do immigrants sign a sponsorship agreement by default while sponsoring their wives/ spouses?

Does the Family Law Act take precedence once the divorce is filed over the immigration law? Can someone please assist?

We need a couple more details? Where you a Canadian citizen that sponsored his wife and children or did you immigrate as a foreign family?

Thank you for your assistance. No we migrated from Dubai as a family. I was not a Canadian citizen or a PR card holder at that time.

This is not a sponsorship so no undertaking was signed. You may have to pay support for her but it will have nothing to do with immigration. It will be governed by the Divorce Act and/or relevent provincial family law legislation. This is not an immigration issue. You need to speak to a divorce lawyer.
