Conjugal is a difficult road to take because unless you get a very lenient visa officer, you must prove that you have been in a marriage like relationship for 1 year or more and that immigration barriers or law of the land is preventing you from living together to qualify as a common law.

Have you been in a marriage like relationship with this man for more than 12 months? Do you support him or he supports you financially? Do you have joint bank accounts, joint property, insurance policies naming each other as beneficiaries and wills naming each other as heirs?

Could you marry him if you wanted to but choose not to? Could you live with him if you wanted to but choose not to? Are you ready to take financial responsibility for him for 3 years after he comes to Canada? Those are questions you need to know the answer to as well.

As for your PR being safe, if you tell the whole story about the affair and your husband forgiving you etc., they may believe that you were already separated from your husband when you sponsored him to Canada which means he got his PR based on misrepresentation and could lose it. Did you actually sponsor him after you got your PR or did you include him on your own PR application as your dependent? If you got your PR first and then sponsored him, you can not sponsor a new partner until your husband has been a PR for 3 years.
thanks very much for the insight leon, great help, i actually included them in my PR application, so would that mean i can sponsor my boyfriend now and would that complicate our status here? its actually over 3 years now since they arrive here. I cant marry my boyfriend because he is also married in the Philppines, and we dont have divorce in our country. i have lots of evidence to present pictures and documents, but my worry is that we had a child before my husband and my eldest child arrives in Canada im worrying that it would affect our status here, would having my citizzenship (which i expect to have anytime soon) help in anyway in my situation? thanks so much for the reply leon

If you had included your husband in your PR application there is no 3 year bar on you sponsoring another partner and if your husband has been a PR for more than 3 years, even if you had sponsored him, your obligation to him would be over already.

However, like I said, if you want to try to sponsor your boyfriend as your conjugal partner, you would have to show that you have had a marriage like relationship for more than a year. Have you? Even if you can not marry, would it be possible for you to live together? Have you tried to get a visit visa for him to come to Canada? Could you go and live with him in the Philippines? These are all questions you may have to answer.

I don't see how you having citizenship would help.

great, your advise has really given me hope amidst despair, one last question though, is there any chance that CIC would tell me that i misrepresented during the time i applied for PR since i already had a child to another man, the same man that i am planning to sponsor? and can i use my youngest child as proof of our genuine relationship since his name is indicated in the birth certificate? and if just in case>our application for conjugal partnership got denied can i reapply it as spouse since were planning to file annulment in the philippines?

I think you should talk to a lawyer. If they believe that you were already separated from your husband at the time you applied for the PR and included him, that could be seen as misrepresentation for both of you, especially if you had split up soon after him arriving with his PR. I have no idea how likely that is to happen. Best talk to a lawyer about what your strategy should be.

Your child with your boyfriend does not prove that your relationship with him now is genuine. The child shows that you had an affair with your boyfriend at the time but if you mean to say that your relationship was genuine and ongoing after the child was born, then you have just told immigration that you were not serious about your husband at the time you applied for his PR which would mean you misrepresented.

If you do apply as conjugal and get denied, you can apply again if you marry.

Hello there!
mine was also uncontested at sabi ko nga i got my divorce cert last month...no need the appearance, mind you super dali lang. punta ka sa family law centre sa kung anumang city ka,then ask for help from the people in LINC,sila mismo ang gumawa ng lahat ng papel ko.
@weary-damsil31 how much did you pay for your divorce process??

yeah, and we are also planning to take the same route, because my boyfriend is a married guy in the philippines. can you share to us how you started your application and things that you have undertaken, your reply would be very much appreciated.

i was just wondering, he already filed an annulment case and it seems that its going to take a lot of time, i was wondering if its better for us to not to mention it on our application, im worried that cic would advise us to wait for the result instead? any opinion?

hello emrn,

can you tell me about your situation regarding how did you qualify as conjugal partner it seem you were approved and waiting for the visa..

see my time line

My Girlfriend is a PR but next year will be a citizen in Canada. She sponsored me as common law under conjugal relation-partner. I lived in the Philippines, single. I have know her since January 2010 when I was in Bahrain and she visited me in the Philippines on March 2011 when I came home and return back to Canada in April the same year. After a year we applied for this Sponsorship Conjugal Partner. Can we apply for this route?

here is our facts:

1. She was married before separated 12 years but have separation agreement notorized.
2. We only live each other for 1 month March-April 2011 at same address.
3. We have continuous communication like emails, chat,(yahoomail, Messenger and Skype) card, letters. Beneficiary both our names, will of testaments of both, photos of both of us and with both of our family members, letter of Two Statutory Declarations from friends/family including her employer, Income Tax included my name and sending me money monthly thru money transfer,
4. She had a divorce application in alberta waiting for approval\decision.
5. We can not get married because there is no divorce in the Philippines, she had no means to apply for annulment. She didn't know where his whereabouts to fill it
6. I can't go to Canada as well TRV will be refused because of lack of fund in my accounts but I have a land which was inherited to my parents which I reside till now.
7. She can't live with me in the Philippines because of her employer and she mortgage car and cannot left Canada for long because of her PR-Citizen requirement.

Are these are grounds that we applied for conjugal partner sponsorship? Any suggestion??
