My situation is really bad. Is there a way for me to sponsor my girlfriend and our 2yr old son. My girlfriend is married, its been 2yrs now since she filed for annulment. It looks like the annulment case is going anywhere. Theres no divorce in the Philippines.

Is there a way to sponsor my girlfirend and our son?

Unless you cannot prove the relationship of your girlfriend as your spouse, common-law or conjugal partner,you are not eligible for sponsorship.

Are you able to live with her? Or are you in Canada and she is in the Phillipines and unable to come to Canada to live with you?

If you're living together, you can file as common-law partner.

If you're in Canada and she's in the Phillipines and unable to come to Canada, you may qualify for Conjugal. You should search the forum and read up about it before making any decisions. It's a difficult class to qualify for.

I am in canada and she is in the philippines. I can only visit both of them for 3 weeks as my vacation.
I really want to be with them as soon as possible, but the thing is, the annulment case is taking forever.
Can both of them apply for a temporary resident visa, what are the requirements? Im really new in these forum, need help and advice badly.

they could potentially visit and then extend their visitor's visa. but the larger issue is how to get them sponsored? to qualify for common-law, i think you need to be living together for about a year and file for things together (like taxes) to be considered for common law.

can she find work in Canada?

I dont think she is able to work in canada.
Im lossing hope, especially with the annulment case taking forever for the first hearing.

My best bet right is the temporary resident visa, until her annulment case is finish.

The Visitor Visa has pretty much 0 chance of being approved for her. Her boyfriend is Canadian (and yes, she must declare you). She's an overstay risk.

Are you legally able to live in the Phillipines?

You may have a case for Conjugal, but you need to be careful. If you're able to live in the Phillipines and chose not to because of work, you may be denied. I believe co-habitation is also illegal in the Phillipines, so that might be the way to go.... can't get married and can't live together because of no Visitor Visa/co-habitation illegal.

Before you do anything with a Conjugal application, however, you need to do serious research. I would consult (free) with several lawyers. Let them think you're dirt poor and see what they have to say.

I have couple of friends like this. There is no better way than to get a better lawyer to fix her annulment first. After that, then you can get married and get her as your spouse. For now, all you can do to be with them is to visit them whenever possible. If you apply for conjugal and VO in manila finds out that she is still legally married to someone else, this might cause her and her application a lot of trouble because they might think this is a sponsorship out of convenience.

I thought I would point out that your son does not need to be sponsored if you are canadian born your citizenship can be passed on to your son. You should get his birth certificate and file the appropriate paperwork with the Canadian consulate to get his paperwork done. This will not help his mother to come to Canada, however, it will be one more step that you have completed in the long spousal sponsorship process that will not cause you to have to wait even longer.
