Hi, I've been with my south american partner for 4 years, travelling from Canada to visit many, many times for both work and pleasure. We tried for a visitor visa to canada a few years ago but they were denied, we assume due to not having stronger ties, and so i have been spending more and more time travelling down. This past December we got married in south america and since i work remotely... I decided to stay so we could be together.
I have since blown through my 3 month Visitor Visa in their country in order to stay with them until our spousal sponsorship paperwork is approved. I know they can't come to canada yet and made this decision without really thinking about repercussions, however it is now the situation. I'm not too worried about it, i'll probably get a fine and be not allowed back for a bit while on the way back home eventually.
My concern now while doing the sponshorship application is how overstaying my visitor visa in their country might affect the canada immigration decision. For example, when being asked if we are living together... I am saying 'no we're not' because I'm just a visitor in their country, and am a canadian citizen. I don't work in their country or have any legal status other than visitor. When I do the application and it asks about 'Are you liviing together? No? why not?" and "have you visited each other? explain?".... i'm sort of at a loss as to how forth coming i should be. I'm not really sure how to answer in the best way and so far have been simply telling the truth. I came down on a Visitor Visa, paperwork had to be redone twice to be accepted by the civil registry here which wasted many months, i stayed during that time, and we eventually married in Dec. Now, I'm still here while we do the paperwork.
Am I going to have issues with canada immigration and the sponsorship application considering the situation I've put myself in by overstaying my visitor visa in their country? I'm pretty sure it will be easy to see our relationship is genuine since we worked together at the same international company and have been together for years. Just sweating a bit about how to present the fact that i'm still here... while indicating in the forms that we are not technically living together, even though physically we are (and have been for the past year.. yes i move slow).
