Hi everyone,

I have a minor son back home. My first child when I was on my 20’s which I mistakenly did not declare. In our first application, I was the SOWP. We are still a Temporary residence in Canada. Is there any possible way I can bring my child here in Canada even if I ask help from his father?

If not PR, then current status is what? What is your job? Is father biological and what is his job? When do permits expire? Do you have full custody? Need to give a lot more information.

I’m a Spouse open work permit, currently working as a administrative assistant. My work permit expires this coming September 2025 but I already secure a study permit, which starts this coming Fall. His father, is not in Canada but he’s willing to support for whatever application I will apply. Yes, I have the full custody of the child. My mother in law is the one taking care of him.

My husband, was a study permit. He didn’t finish his studies because of wrong decision and proper advice. He was banned for 6 months, converted to visitor visa and not allowed to make any applications. We both made a mistake about not declaring my son.

You can try applying for your son. You will need to include an LOE explaining why you failed to declare him in all previous applications. It may be best to use a lawyer for this application. No one here can tell you if your son will be approved or denied. This is not a straight forward case.

Yes, I already talked to one of the immigration consultant. Would it be the best to talk to a lawyer instead? The immigration consultant advised to wait for PR or on his 18th Birthday. But It’s way too long to wait. What if I risk to apply? Would my temporary residency in Canada be in jeopardy?

Talk to a lawyer.

I don't understand why you would wait for his 18th birthday. This is nonsense advice.

Ban from studying or being in Canada? What program are you enrolling in? You may no longer qualify to have dependents with you while you study.

They mentioned that it would lead to misinterpretation. I’m enrolling 1 year program. Yes, I know, unless im taking masters program or some selected bachelor program.

The reason why we failed to declare my son because we thought that he must be the same last name as my current husband (not the biological father. Should’ve been easy to declare but we failed and cause a big mistake.

First application is study permit (husband), spouse open work permit (me).

It’s so sad, that we just realized when we arrived in Canada in July 2023.
