Over the past year, Citizenship and Immigration Canada (CIC) has been returning fees paid to the Department for Federal Skilled Worker (FSW) applications terminated as a result of the Government of Canada's Jobs, Growth and Long-Term Prosperity Act.

If you applied before February 27, 2008, and have not heard from CIC about whether a decision based on FSW program selection criteria (*see below) was made on your application, you may be affected by this law.

If you fall under this category, CIC needs to verify your contact information is up to date so that your fee return will reach you at your current address. Please note that interest will not be paid on the fees.

Please confirm your latest contact details by sending CIC this form (PDF, 1.4 MB). Communicating with us electronically is the best and easiest way to have your fee return processed.

Due to the large number of affected applicants, the fee return process may take some time. We expect most people will receive their fees back within six months, but there may be possible delays in cases where applicants are located in countries with international banking restrictions. We appreciate your patience.

Your FSW application has been terminated by operation of law if:

you applied before February 27, 2008, and
a decision based on FSW program selection criteria* was not made on your application by an immigration officer before March 29, 2012.

(*A “FSW program selection criteria” decision means that a CIC officer has determined that you have accumulated enough points to qualify for the program, based on factors such as your language skills, education and work experience.)

As you have a relative / friend there it would cost you just $5. Its very easy. Your relative / friend will order this on your behalf and he will be the requester. It can be done by email and your relative / requester can send scan copies of everything. Your relative / friend will receive CAIPS / GCMS notes in his email.

First fill the following form but your relative / friend will sign it as he is the requester.

Now according to latest IMM5563E form you can even pay fees online if you are not living in Canada and there is no need to fill any credit card form. That data spread sheet is outdated ( July 09, 2013). The link I gave u regarding backlog was dated October 18, 2013 which is more recent.

Yes, i did think the numbers looked slightly different in the link.

TBH seems quite a backlog to get through.

What does C50 MI1, MI2 and MI3 mean, sorry

Ministerial Instructions (MI1)*: Federal Skilled Workers
Under the first set of Ministerial Instructions (MI1) issued on November 29, 2008, CIC began to limit the type of Federal Skilled Worker (FSW) applications received to the following categories:

a) applicants with an arranged employment offer;
b) applicants with work experience in one of 38 in-demand occupations; and
c) applicants in Canada as students or temporary foreign workers.
MI1 was applied retroactively to FSW applications received on or after February 27, 2008. Read the full text of MI1.
*Note that MI1 was superseded by MI2’s issuance (see below)*

Ministerial Instructions (MI2)*: Federal Skilled Workers, Canadian Experience Class, Immigrant Investor Program
As part of the second set of Ministerial Instructions (MI2) released on June 26, 2010, CIC capped the number of new FSW applications to be processed at 20,000, not including applications with an arranged employment offer. The Department also responded to evolving labour market trends by issuing an updated FSW eligibility list of 29 occupations, each capped at no more than 1,000 applications. In addition, FSW and Canadian Experience Class principal applicants became subject to mandatory language testing. MI2 also included a temporary pause on new federal Immigrant Investor Program (IIP) applications. Read the full text of MI2.

Ministerial Instructions (MI3)*: Federal Skilled Workers, Immigrant Investor Program, Entrepreneurs
Effective July 1, 2011, the third set of Ministerial Instructions (MI3) further limited the intake of new FSW applications by lowering the global cap to 10,000, with sub-caps of 500 for each of the 29 priority occupations. It introduced an annual cap of 700 for new applications made under the federal Immigrant Investor Program, and also included a temporary moratorium on Entrepreneur applications while that program undergoes review. I checked in spreadsheet, for LVO still there is no update. Therefore I posted it on forum if by chance anyone has recvd MR.

I know its frustrating we are all waiting for something from London. I'm sure we will hear something. Just unsure as to when. There does seem to be quite a backlog of files at London though which could explain why we haven't heard anything.

Keep looking on this thread, Im sure the first person to hear will post on this.

Good luck, when did your file get transferred to the LVO?

The data-spreadsheet shows the latest data (posted by CIC), updated early November 2013. Your link is in regard to a press release about the termination of certain pre-c50 cases (before Feb. 2008) - which was done early 2012. Still, several VOs have a lot of those cases left.

C50 includes all programs after Feb. 2008, so it includes all MIs
MI1 - Feb 2008 - June 2010
MI2 - June 2010 - July 2011
MI3 - July 2011 - May 2013

Everything earlier is "pre-c50", i.e. until Feb. 2008. Those files were terminated by law early 2012, unless they had reached a certain stage. As far as I know, some 300,000 files were affected by this, thus reducing the global backlog from around 850,000 persons (in 2011) to around 530,000 persons (in 2012).

If you see different numbers in the spreadsheet - make sure, you check the right page (SW cases).
