I have a question, and hopefully someone might know better...

My sister sponsored her husband in Feb 2013. First stage was approved and he was issued a work permit. (in-land sponsorship)

However, due to extreme marital issues, she has decided to withdraw his application for PR.

His application started processing December 31, 2013. Medical Results were received.

After she sent the email to withdraw, and mailing the letter, the status has changed to "Decision Made. The office will contact *** *** concerning this decision".

Can we assume that the withdrawal was successful? That his application has been rejected?

If you withdraw your application, you will get a refund save the $75 sponsorship processing fee. US will be faster (6 months) and you will be ready to work. Going inland again will keep you out of the job for lady gaga knows how long. You lose more inland than outland at this point.

That is likely what the situation is, yes. I hope she is absolutely certain this is what she wanted, because it can not be reversed now.

Give him some time, and you can find out exactly how much would it cost to apply Outland compare to inland. But azarme is right, if you apply quickly, with a little luck you will be able to work at the beginning of the next year.

I applied in Feb. 2014 inland and had my entire app. returned to me 5 months later due to an outdated form, which was the first communication I received. I applied Outland instead and honestly it was the best thing that could have happened to me. According to the timelines for my VO(London), I should have my PR card by February at the latest while Inland applicants from last August don't even have Stage 1 approval. There are US Outland applicants on this board that got their PR in THREE MONTHS start to finish. Throwing yourselves to the back of the Inland queue at this point would be extremely unwise in my opinion. I completely understand how you feel as I have been in your shoes but I also believe that this may be a blessing in disguise for you! All the best

I tried to explain to him how much shorter the outland process is at this time compared to inland but he still worries. Our rep says that either way she can request an expedited process, Although I know chances of that are slim, since the mess up is completely on CIC and not our application. I mean really if it was so incomplete why did they not send it all back when they sent the one form to be re-signed 2 months ago?!?!? And everything is there and they are the most updated forms........ okay I am done venting for now. Just feel sad that after 4+ months we are no closer than the day we sent applications in :mad:
Because CIC hasn't actually started processing anything at this point, it really would behoove you to file an outland application. All of your fees/ payments can be transferred for the new application. The most it would cost you at this point is the fee for a new FBI report, the old one is out of date now based on what you said your timeline is, and if you haven't done your medicals yet, you will need to get those done. I don't know if your consultant would charge an extra fee to file a new application. There are other minimal costs, but if money is tight for you now, it's only going to get worse, much worse if you continue with your inland application and get sent to the 'back of the line'. Of course, it's not a fact that you will, your spot might be held, but it's still a long way off from the end. US Citizens are moving markedly fast to get their full PR. You might want to hop on that train while it's full steam ahead ;)

Being from the US, the odds of you/him needing an interview is slim to none. I know exactly what you mean when you say the consultant he trusts, believe me, my spouse did the same thing. We now both wish we'd saved that extra money for something better as they really didn't DO anything. All they did was ask the questions, I answered, they typed. I could've done that ;)

Really ? They returned your entire app for an outdated form 5 months later without give you any news even AOR ? Do you remember which form was outdated ?
I ask you that because we applied in february too ... And we are little bit afraid now ...

Thank you.

This is absolutely what she wants. He was abusing her, and eventually walked out on her, and there is no chance of reconciliation between them. She'll be filing for divorce soon.

I just want to mention what a call centre agent told me yesterday about this issue. According to him (and he had to consult with a senior agent before giving me an answer), fees cannot and will not be transferred to a new application. He said that your receipt (IMM5401) is linked to the initial application and that cannot be changed. You either wait for a refund (which can take substantially longer than the 16 weeks stated on their website) or pay the fees again upfront when you submit your new application.

Just saying because I'm in the same situation and I also was under the impression that the fees could be 'transferred' if they hadn't started to process the application, but apparently this is not the case.

Just saying because I'm in the same situation and I also was under the impression that the fees could be 'transferred' if they hadn't started to process the application, but apparently this is not the case.

I'm afraid that isn't correct. I used the same receipt from my Inland application for my Outland one with no problem at all. As long as your application wasn't processed (ie returned unprocessed) you can still use the same receipts.

I'm just saying what they told me. Seeing that they are very inconsistent and usually can't tell their ass from their elbow, maybe it's better to ask first to see what applies in your particular situation, which imo is ridiculous as there should be a set standard.

Ya, not a word, not even an AOR until the application arrived back on our doorstep (in a plastic bag, with the envelope ripped and contents falling all over the place :/)
It wasn't one of the forms that had been recently updated, I think it was the Background declaration, it was completely my own fault for not checking before we mailed it but still quite harsh in my opinion!
Still it worked out for the best!

I agree completely....calling CIC is pure luck of the draw, you can call 5 times with the same query and get 5 different answers! And no accountability either right, like I can't make note on my application which agent told me what on what date...I'm just sharing my experience too, to add to the confusion! Thanks for your response.

It is frustrating that they are saying that forms are outdated when they were not outdated when the applications were sent in they may in some cases be outdated by the time someone at CIC looks at the packet. In our case they had looked enough a our application to see that I had signed one form in the wrong place so they sent that form asking me to re-sign it and return. At that time we decided to be proactive and re did the Dependent form as well. Now they are saying that they need the updated dependent form which they had in our application packet! If they are going to take months to look at packets they can't expect that there won't be a need to update forms, but it is because of them not because of the person applying... GRRRRRR

I think we will do outland I just have to give my husband a few days to process things.

I would apply outland, it seems its a much faster process and if you have no red flags they shouldn't call you in for an interview.
I somewhat regret not applying outland when sponsoring my husband.
