If this is confirmed, it is meant to enforce the rules of those on IEC and PGWP. They will not able to assume that they will get "implied status" on these type of work visas. They will have to quit as they are suppose to.

So it would mean that you would have to submit a work extension, a study extension, or a visitor extension separately to maintain your status.

UH OHH...

This is confusing me a little now..

I'm on my PGWP that's good till FEB, 2015 and my application was received by cpc-vegreville on the 14th, January but i did not include OWP as i thought I could apply after i get my AIP..

So, then, if i don't get my AIP before Feb next year, should i apply for a VISITOR staus??? :-(

If apply for owp when you get AIP and get owp approved before your PGWP expires, then nothing changes. However if you do not get owp before your PGWP expires, you have to quit your job until you get owp approved.

It would be sucky if i had to quit my job......:-(

What if i get AIP in August, or September this year? It is kind of too early to apply for OWP, I mean, my pgwp status ends in 5-6 months from the point I get AIP..Would it matter?

Thank you Jamesdavid for sharing this! In this case, I won’t apply for an OWP as soon as I get my UCI :( But still, there are two forms and I can’t decide which one they need, could you please help me?

Application to Remain in Canada as a Temporary Resident Permit Holder
http://www.cic.gc.ca/english/information/applications/extend-permit.asp

Application to Change Conditions or Extend Your Stay in Canada as a Visitor
http://www.cic.gc.ca/english/information/applications/visitor.asp

The main form, IMM 5708 is the same, but they need different documents, the checklist is different and the fee as well.

It would be so sucky if you had to quit your pgwp but depending on the timing, if your visa expires one and and your owp isn't expected to be approve for another week, you could ask your employer for a leave of absence until you get your owp. You are not technically quitting your job but merely you are not legally working/getting paid during your leave of absence and your job is still there.

Mind you this is an idea that might work with employer.

From what I'm reading on your post, it appears if all goes well, you should get your owp before your pgwp expires.

I'm pretty sure they will be able to accommodate my request..

You could've got it when you were working.. As a foreign worker, You need to bring an employment letter, passport and your visa to a close service canada office..

However, since you're not employed now, you need to wait until you get your AIP, then you can apply,..
That's not exactly true. As long as you have a valid working permit, whether or not you still work there is irrelevant. You do not need to bring a letter of employment. If you bring your passport and mailed statements (such as VISA or from a bank account), it should be sufficient to get OHIP.

That IS true. I have a post graduate work permit, and when I was applying for OHIP, service canada specifically asked for an employment letter

I don't know if this is true after you get AIP, but with all other work permits before you get AIP, you do NEED an employment letter

Well, my spouse has OHIP and I got it with her with a regular working permit (with an LMO), and we did not present a letter from her employer.

I filed her PR a few weeks ago, and I got her OHIP several months ago.

So it's definitely possible, as she has been using it just fine :).

EDIT: To expand on this slightly, when we applied we were presented with this document about proof:
http://www.forms.ssb.gov.on.ca/mbs/ssb/forms/ssbforms.nsf/GetFileAttach/014-9998E-82~1/$File/9998-82E.pdf

You will notice you require 3 documents, one from each category. However, with a work permit and a passport, that satisfies column 1 & 3. So the only one we had to satisfy was column 2 (proof of residency), which CAN be a letter from employer. Instead, however, we simply used recent mailed bank statements, which were accepted with no incident (we were too lazy to get the letter from her employer).

Maybe it's different for a pgwp, I have no idea, but for a regular work permit it was by-the-books from this form.

**BIG UPDATE FROM THE CIC***

Anyone being sponsored by a Canadian spouse or common-law partner, listen up. On January 15, 2014, the government changed the processing stream of IN CANADA CLASS spousal and common-law sponsorship applications. These are now to be sent to the Case Processing Centre in Mississauga. The Case Processing Centre in Vegreville will no longer be processing these applications. AND, you can no longer include an application for an Open Work Permit or Visitor Extension WITH your sponsorship and PR applications. CPC Mississauga will let you know when or if you can apply for the OWP and you must submit visitor extensions separately to Vegreville. There is no longer any possibility of being able to continue working on implied status by including the OWP application with the PR application. This applies ONLY to those who have NOT submitted your application yet. Those who have already submitted your applications do not need to worry about this

**Unconfirmed**
Where did you find this info ? What about the ones that just want to send more supporting documents ?

I did find this on the website.

http://www.cic.gc.ca/english/information/offices/canada/mississauga.asp

However, I didn't find any info on the OWP yet.

So I'm assuming that no one will have implied status now when they submit their app? Is it necessary to stay in status as an applicant?

I wonder what this is going to do to processing times. Sigh.

If you look at the Document Checklist for In Canada Class sponsorships, you'll see that the address for submission of the application has changed to CPC Mississauga. CPC Mississauga cannot process temporary extension applications for applicants in Canada, only CPC Vegreville can do that. Call the Call Centre yourself to verify if you like. Here's a link to the new checklist. http://www.cic.gc.ca/english/pdf/kits/forms/IMM5443E.pdf

Does that mean inland applications for everyone (regardless of visa type) no longer get implied status at all (if they haven't applied yet)?

It basically means they will only get "implied status" when you submit the extension forms before it expires. The time between when the last day of visa stay, work visa or study visa, to the time a decision is made, approved or not approved would be considered "implied status".

Hm, but the main advantage to being able to include an OWP was that if AIP took a long time, you had implied status until the OWP was processed. But, you can't apply for OWP until you have AIP, which means that now, if someone goes out of status before AIP, they're screwed and have to apply for a renewal of whatever visa they currently have, and potentially an OWP after (if that's even still allowed).

Which basically means it's the same as applying outland, except it takes a lot longer. So I'm not sure what the advantage to applying inland will be anymore.
