Hi guys I came across this thread and I thought I'd post my story,
I'm married my Canadian in July 2012, Immediately sent our application in August.

So here is my timeline I guess:
Application Sent: August 2012
Started processing sponsorship: November 2012
Sponsorship and Eligibility Approved: Feb 2013
Medical: I will be doing that next week so Feb 2013
Med Received:??
PPR:??
LANDED:??

So my question is, how long after the Medical is done before the CIC asks for the Passport for stamping?
Does anyone have an Idea? I've hears thet if everything was well it will be within 2-4 months. Not sure tho. HELP!
Another thing is when they ask for it, how long do they give you for a deadline. For example They give you 90 days for them to receive your medical and police clearance if you don't have one.
I am asking this because I am changing my passport to my husband's last name, (yes in the middle of the application)
I know others may think that this will complicate the process but I want my COPR to be in my husband's last name. because for some of you who do not know the COPR (certificate of permanent residency) Is a Historical document, So no matter what happens whatever your name was when you got it, It will never change or be allowed to be changed. You can change the PR Card name but the COPR will stay the same. So long story short I want all my paper works to be in uniform with me having my hubby's last name. Don't worry I have read everything I need to on changing the name in the application.

I still currently have an option not to change my passport because the Philippine Consulate outreach won't be here till next month, in which I have an appointment to change my passport. So this is my dilemma, If the CIC won't need it till 3-4 months later I will have enough time to receive my passport in time. Thank you for reading my story.

PS. Our application is Inland and The visa office is Vegreville.

Hi, I got married in Nov. and sent the solemnization paper in with the application, I received AOR before I received the marriage certificate and sent it in when I received it.

No, it really takes that long.

We got married December 4th, 2011 and it wasn't registered until April 2nd, 2012. It was a very frustrating wait!

Implied status does not arise from the PR application, it arises from the temporary status application you send WITH the PR application - visitor, study or open work permit application.

If you don't include a temporary status application, you don't get implied status and you go "out of status".

For inland spousal sponsorship the public policy is to allow sponsoring out-of-status applicants. But better to stay in status.

Hi Computergeek,

Are you referring to the application to extend your stay as a visitor or worker?

Thanks.

If you have everything else in order send it in with the solemnization and state you will send marriage certificate when you receive it. There are several people on the forum that only sent the solemnization and were approved.

Hi Computergeek,
Thanks for your comment :)

Have you any idea what this means:

Maintaining legal status

Spouses and common‑law partners of Canadian citizens and permanent residents in Canada who wish to apply for permanent resident status are no longer required to have legal immigration status provided that they have an eligible sponsor. All other eligibility requirements continue to apply.

It's a quote from this page on the CIC site: http://www.cic.gc.ca/english/information/applications/guides/5289ETOC.asp

I'm waiting for my visitor record to be posted back, applied in December! So I'll be good until mid July. Will probably extend it again if I dont get AIP by then.

Thanks.

@ UKZippy

That quote means basically what computergeek said in that last sentence. You can be sponsored even if you don't have a legal immigration status (i.e. no work permit, study permit, or visitor visa). This is as long as you don't have a deportation order against you and you meet all the other eligibility criteria.

It's technically "change status or extend your stay" but yes, that's the form. And you can pick visitor, worker or student.

If you do the work permit, you should write "Open Work Permit - in-Canada Spousal Applicant" on the top. OWPs must be submitted on paper still.

Acknowledgment of Receipt

Welcome to the forum. Did you submit a temporary status application along with the permanent resident application, e.g., open work permit? You can wait until AIP to apply, but then it takes longer. Your husband will return to being in-status at that point. Of course, it is public policy not to seek removal simply because someone is out of status when they have an inland application.

Good luck!

Thanks, and no, we did not send in a temporary status application along with the PR application (or an open work permit) I have just been reading a bit about that now. I knew and read up about the public policy beforehand though. What generally happens when an applicant is out of status? I am sure it must be dealt with at some point and we have heard different stories from different people.

Also, is it possible (or even a good idea) to send additional documents AFTER the application has been sent? I am wondering now if we SHOULD send in the OWP and ask that it be added to our application ... plus, we received a few letters of support from friends (we got them the day AFTER we mailed the package off...grr) Just not sure if it is frowned upon.

It's not uncommon for people to add an OWP to their file. You just need to make sure you clearly label anything you send in with your file number (and other identifying information). CIC can find matching up paperwork a bit of a challenge - they handle a LOT of paperwork - so make it as easy as you can to get the addition into your main file.
