Immigration Barrier, please help!

we areplanning to apply as a conjugal partner, and there is one question that i really need help... its said there visa denials - trying to live together but unable to do so?


we are in the same sex relationship. my gf tried to apply at express entry in Nova scotia and she didn't meet the minimum requirement of 67 points. she only got 65 points. I help her alot to do all this application and her her for all the expenses,. in case that she will get approve im planning to move in Nova scotia and settle with her.

myquestion is can i use this as a immigration barrier? I live in Edmonton by the way.

please help

Probably won't work as conjugal as you can go for visits and marry him/her. If you are a Canadian citizen you can even live with her and apply from abroad. Conjugal has to have really serious barriers, unless you cannot go to his/her country or be together there it will be hard to go by

we have tons of evidence that we are in a relationship i visited her 3 times since 2013 i keep going back in the philippines. we travelled together and joint accounts and evrything
..

we cant live together because of her parents not favor in our relationship. and im here in canada. she tried to apply in nova scotia for permanent resident but she got refuse. my question is can we use this as a reason that we tried to live together but she got refuse,

You can certainly try but chances of refusal are still high. You would have much better chance getting married in Thailand and then apply as married couple.

Has she been refused for a visitor TRV to come to Canada where you could get married?
Have you tried going to another country where same-sex marriage is legal to get married?

These are the kind of questions a visa officer will consider when reviewing a conjugal application. While only the visa officer can know if they will accept your conjugal app, the chances are quite low since it's not a legal impossibility for you to get married.

You need to try, as a TRV refusal will strengthen any conjugal app. Not even attempting for a TRV will not look good.

Even then a conjugal app will be a very tough process, with a high chance of refusal.
Getting married in a 3rd country where Philippine citizens can travel to easier, will make the process a heck of a lot easier and quicker with much higher chance of success. The choice is yours.

Since you have visited her three times, conjugal definitely won't work. Is the issue that gay marriage is illegal in her home country? If so, I would suggest looking into both of you traveling to a third country where gay marriage is legal, but where she won't need a visa in order to visit.

That in itself is not a bar to a conjugal app.
Obviously marriage is not possible there. And you can argue that it's also impossible to reside there for 12 continuous months due to maximum length of a visitor visa allowed to foreigners in the Philippines, or that living together as a same-sex couple would present hardships due to it not being generally accepted. Of course whether to accept these reasons, is up to the visa officer.

i keep do read of information of conjugal

but ive never read anything about visa refusal.

all in are social aspects, physical aspects, financial aspects

If you have the money, your best bet is to go to some other country where gay marriage is legal and it's also easier for Filipinos to get a visa, and then get married there (countries such as New Zealand for instance).

You sound like you already have good proof for genuine marriage with the 3 visits. While conjugal might be possible, it requires the most proof, and I'm pretty sure many conjugal end up needing an interview.

i could be wrong, but my understanding is that, when they speak of not being able to get married, it's because same-sex marriage is illegal in the person's country - not that their parents don't know or don't approve. and again, my understanding is that, since same-sex marriage is legal in Canada, the question will be 'why didn't you try to get married here?'.. which can be explained by a refused TRV.. or, if she applies for a TRV and gets it, then you can get married here and apply as a married couple as opposed to conjugal.
