Hello all. Again I’m stuck with few questions. My spouse is having a valid PGWP until next March with a full time contract job, myself having a SOWP without a job,my kids are holding Study & visitor visa. Now we submitted H&C last December, I understand we have to wait for a year or more to receive the AIP, but in some forum they mentioned Work permit can be applied if we have received AOR. Is that true?

Work permit is only guaranteed once you have AIP. We have seen some limited cases where people have been successful in obtaining a work permit with just AOR. However this isn't by any means guaranteed. You can try applying but you need to be prepared to stop working between the time your current work permits expire and the time you get AIP and new work permits.

Won't they get a maintained status if they apply before expiration date?

Yes, you're right. They would until the work permit application is refused.

Thanks @scylla & @CanGoldDigger . What we thought is, as we have a valid permits now, we can try applying with AOR as the processing time is around 6+ months for Work permit. in the meanwhile if we get AIP, we will be able to submit that through webform. If we dint get any response for AIP until next March, we want to have a try with this AOR beforehand to avoid out of status.!
 
But if my kid’s study permit expired next year & if we want to convert to TRV, will she be able to continue her school?

You mean a visitor status? Why would you need to covert?

If it's primary or secondary, they won't need a study permit if you have a worker status. But they need a status anyways so the kids can apply to change for a visitor status .
 
Oh. I heard from the school board we need to submit the new Study permit once it expires next year. We were on an impression for minors study permit extension would be granted. Also my son, who holds visitor visa until next March, will start his schooling by September 2026, so should I apply for Study permit? So should we just apply for visitor status?
