I was sponsered and divorced, can I sponsor new spouse immidiately?

Both my husband and I were in Canada on workpermit for 2 years (his was main work permit, mine was open work permit because of his job). Ours is a marriage of 4 years, even before we came to Canada, no kids. We applied for permanent residency on skilled worker category. He was main applicant and I was sponsored by him. We got it in early 2009.

We got divorced recently within a year after we got PR. Now, I want to marry another person from outside the country (India) and want to sponsor him here. I have a good job in Ontario, so financially I am OK.

However, I read that if a person has sponsored a spouse to Canada, he/she cannot sponsor another spouse for another 3 years. I am not sure if it applies to me, as I was sponsored as a spouse and did not sponsor anybody. Can you clarify if I can sponsor my new husband immediately or should I wait for 2 more years before I qualify as a sponsor? Also, would there be a delay in Visa processing?

You weren't "sponsored", you became a PR as an accompanying dependent on your ex-husband's PR application - that's very different to sponsorship.

You are eligible to sponsor in theory - if the previous relationship was genuine (i.e. there was no misrepresentation in gaining your PR status) and if the new relationship is also genuine.

Expect CIC to investigate very closely though, as even if your situation is entirely genuine, CIC will suspect that your previous marriage was entered into merely as a way to get you PR status. If they decide that is the case, they could remove your PR status, as well as refuse the sponsorship of your new husband.

Thanks for the answers. Yes, I know it looks suspicious. However, details of my case would clarify this.

We were married in 2002, when we were in USA and had not even had a faintist idea that we will be moving to Canada.

We moved to Canada because of Husbands job, and then applied for PR. By the time we got PR relation was sore, but it dragged on for about 6 months trying to reconcile and then we applied for divorce.

Since we were married much before we moved to canada, our marriage is not marriage of convinience. So it should be easy to prove.

As far as my new to-be-husband is concerned, he was also married before in India in 2006 and was divorced in 2008. I met on the net recently through mutual friends and we hit on. I am not sure how I can prove the geunineness of this relationship.

I am sure I will be able to prove the geunineness ultimately. I am more worried about the time it takes. A straightforward case would take minimal 4 months, 2 months in Mississauga and 2 more months in New Delhi. However, since it is second marriage, I am worried it would be dragged in for ever by people in New Delhi. So, I am wondering if it would be a good idea to marry him get him here on work permit or study permit and then make hip to independently apply for immigration under skilled worker program? (he is well qualified). Can I do that? or once I marry him, I should sponsor him before get him to the country?

Maybe if he can get a workers or student visa, you can get married and cohabitate for awhile and build up the proof of your relationship and then apply under spousal.

Sorry maye i missed it,did you spend anytime with this guy at all,anywhere,pictures proof,i can almost tell you for sure if you have no proof of your re;ationship it will never fly.So if you are sure spend time tae time prove then apply.

I think you will really have a hard time sponsoring your new partner. You have to look at CIC point of view, just base on what you post and your situation. You should be very careful, because CIC might really investigate and take away your PR card. Good luck.
