I don't understand does applying for second h&c mean reconsideration ? my lawyer said he gonna ask the officer who made a decision to reconsider his decision but it's not second h&C? someone please help answer my question seems like you guys don't wanna help me

Applying for a second H&C means submitting a second H&C application. No, this is not reconsideration. Reconsideration is something different.

Not sure why you think people here don't want to help you. People answer questions here for free and this means you don't always get a response immediately. Sometimes you need to wait.

OMG, wait. I know what you mean. Because my mother is suing people she doesnt speak french or English. I am in charge for her. If you are in Montreal, Legal aid is useless, it depends on the person's work ethic. I emailed them every week but they were lazy to reply. So i paid a private lawyer to start the case then waiting for transfer mandate.

i have been dealing with lawsuits several times in Canada and home country, never saw someone so unrelaible and slow.

To be fair many legal aid lawyers are very dedicated but are only paid a fixed amount and have many cases so don’t have the time to reply to every question like a private lawyer who can bill for every minute of time used on a case. Many could have made significantly more working in other types of law or only in private practice. Many countries, like the US, don’t even give asylum seekers access to free legal representation so access to free legal representation is a huge benefit. People always have the option to pay a private lawyer but if they can’t afford one they aren’t left with zero representation.

My question exactly it's like they have paused H& C applications processing. Maybe priority been given to Ukraine.

There was a push to approve cases before the end of 2021 because the Liberal government was trying to meet their 400k PR target. Processing times seeem to have returned to a more typical timeframe.

I applied April 2020 got refused today my lawyer said there is a new rule in H&C they’re refusing approved application. Because of Ukraine crisis.

Think something got lost in translation. Think that H&C processing being delayed due to Ukraine is a much more likely or files from Ukraine being prioritized are more likely scenarios. Who gets approved for H&C has nothing to do with Ukrainian citizens coming to Canada.

Go to read people's comments you will have a different perspective. The service is abused. People who are applying for legal aid have no control to their cases. There is no communication at all.
If you want to be grateful, go ahead and do so. No one is stoping you. And it is you luck to be assigned to a responsive one.
It is weird for me to see people only to be grateful instead of monitering how government works. There wouldnt be any improvement. Literally, everyone is paying taxes plus contributing to the society, that's how government exists at the first place.

This is just not fair. Why should they refuse people who are already in Canada. Some of which are already established and are working one way or the other. I agree that Ukrainians need help but it’s not enough reason to deny H&C applications.
I hope you get guidance on what to do because Legal Aides can not assist you.

When it comes to legal aid lawyers it doesn’t necessarily have to do with work ethic. It’s unfair to say that you expect legal aid lawyers to work for free beyond the amount they are being paid by the government while private lawyers can work unlimited amount of hours because they just charge their clients for more billable hours. Yes there are both good and bad lawyers in the private sector and legal aid but yes if you are getting a free lawyer you may not get every email or call responded to if it is not deemed urgent to the success of your application. Would add the it is also unrealistic to allow all legal aid lawyers to have unlimited billable hours for their legal aid cases because the budget for legal aid would expand dramatically and the majority of Canadian tax payers who have to pay for their own legal representation would complain.

There is no proof that H&C applicants are being denied due to people arriving from Ukraine. Approving anyone already in Canada is also not a good policy or else what would be the point of Canada’s various immigration programs if all you had to do is get to Canada and you’d be approved.
