For your case, I proposed to mention both the NOC's responsibilities (according to you, which is the real picture); if someone missed to say something earlier (HR manager roles), it does not mean, he has to continue missing it.

Alternatively, your husband can only claim HR manager experience from 2012 (Jan2004 to Dec2011 : NOC 1122 and Jan2012 to Jun 2014: NOC 0112). In this case, there is no conflict and your husband will get full 10+ years of experience (2 & 1/2 years for HR and 8 years for NOC 1122. Hi century. So my husband can only claim points for HR manager starting 2012 ? If he only has 2 1/2 years , he won't make the 67 points needed And there is no 1122 in the priority list fsw 2014 so he can't claim points for this ??? I am a real estate developer / licensed real estate broker . Can apply under 0121 NOC. Am I better off being the principal applicant instead ?

NO mam. He will get points for both HR roles and as well as consultant roles (point will be awarded for his whole 12 years) and will get maximum 15 points.

Factor 3: Work experience (maximum of 15 points)

You will receive points for the number of years of full-time paid work (or the equivalent in part-time paid work) you have obtained within the last ten years. Full-time means at least 30 hours of paid work in one week.

You must have at least one year of continuous full-time, paid work experience (or the equivalent in continuous part-time work) in the primary occupation you specify in your application.

In order to receive points for all of the jobs you have had over the past ten years, your work experience must be in one or more occupations listed in Skill Type 0, Skill Level A or B of NOC 2011. Follow the Determining your NOC category instructions above to find the NOC 2011 category that matches your skilled work experience over the past ten years.

CIC has sent a reply to one of the returning applicant:

"We do accept Secondary school records that contain the following :

Applicant's Name
Date of Birth
Name of Parent/Parents

If you are not able to provide a Birth certificate with all 3 criteria, we require an affidavit stating all of this information or that a Birth certificate cannot be attained."

So 10th standard school certificate or an affidavit containing applicants name, date of birth and Parent/Parents name should be fine in lieu of a birth certificate. Also you must give reason in a cover letter why you were not able to provide birth certificate and that you are providing 10th standard school certificate / affidavit in lieu of birth certificate.

Nobody knows how they will decide about the convertibility and ability to withdraw the funds. It is the applicant's responsibility to demonstrate the required settlement funds in a liquid and unencumbered state. Most likely, if they are concerned they will ask you to provide further details.

I also don't know whether what you have shown is sufficient. It depends on whether (and to what extent) the PFs can be liquidated and withdrawn as you please. If you could provide details then I could give an opinion.

Don't freak out. If your fund is available, transferable, and free from legal encumberences, it qualifies as settlement fund. PF is valid settlement fund.

Are you depending on this experience to fulfill the minimum requirement of one year of continuous full time experience in your primary NOC? If so you don't meet the minimum requirement and your application will be returned.

Are you depending on this experience to obtain adaptability points for previous work in Canada, and you need those adaptability points to make the pass mark of 67 points? If so you won't make the pass mark and your application will be returned.

However if the answer to both questions is no, meaning you will meet the minimum requirements for your NOC and make the pass mark without your Canadian experience being counted as a full year, then go ahead and apply because you have no problem, you will get credit for 11.5 months of experience which will be added to your other experience to determine your score for work experience.

If you don't meet the minimum requirements there's nothing anyone can do to help you.

No need to mention one application in the other unless you have received a rejection.

If you get PER for both then eventually you will be required to withdraw one of the applications.
