Hi,

I'm not sure this waiting game is good for my health!!!

Our application was received on 16 April in NS with Buffalo as the processing office....no confirmation of receipt or request for next stage although reading other posts it looks like it should be very soon (holding my breath!!!).

Question is this...I have a 2 year work visa which expires on 5 December 2010, if i get my docs back and confirmation of processing before then do i still need to make another temporary residence application? I have read somewhere that the 'pending processing' status is enough for us to remain but i cannot find it again (typical!). Does anyone know if this is correct or i was imagining things!

Oh, another one....can somebody who 'is in the know' post a list of abbreviations and their meanings if possible.

Thanks, and good luck everyone.

Yvette

Hi
My husband was in the same situation back in 2008 and so I am giving you the answer based on the rules that were applicable then. You can contact CIC on there toll free number and get a detailed answer to you queries.
In the case that you get the confirmation of processing before your work permit expires you dont need to apply for a new WP. As you can stay in Canada while waiting for the application to be processed. But you can not leave the country and reenter it on the basis of application in process status. Also while leaving the country you need to get a transit visa which allows you to travel back to your home country.
Also you can apply for the work permit even after your current WP has expired but you need to do this before 30 days of expiration.. if you apply within 90 days of expiration of your workpermit you need to provide a detailed justification for the delay and then the concerned authorities take the decision.
If you apply after 90 days of expiration of your current WP then you need to be present for a hearing at the CIC office and you need to personally explain the reasons for delay to the CIC officer.

My husband applied 45 days before his WP expired, he did not get it before the expiration date. He stayed in Canada for about 40 days after the expiration then he got a transit visa came back to India and got one from here within 6 weeks.

I hope this helps.

Congratulations to MMH93 and Den2can for their AORs.

dear All i got the ans for my own question.. the second phase for FSW immigration is...

Eligibility Review
An officer will make an initial assessment of your application to determine whether:

your application qualifies for processing under one of the three categories described in the Ministerial Instructions
If your application is being recommended for further assessment to a Visa Office, you will be sent a letter that: ( Here WE ALL get 1st AOR Guyssssss)

notifies you of this fact and provides you with your reference number, ( Here Reffrence Number Means FILE NUMBER )
sets out some basic instructions for contact with the Visa Office, and
instructs you to submit a copy of your application and all supporting documentation (see Visa Office specific forms) to the responsible Canadian Visa Office within 120 days (4 months)
If your application does not qualify for processing under the Ministerial Instructions you will be sent a letter that:

provides the reason why your application is not eligible for processing
confirms that a refund for the processing fee will be issued

it means there are the chances to be rejected... Ohhh GOD Help US.........

Dear dont be so afraid, all happens with the order of God, we all have firm belief in this, I suggest you just wait for 3week or 4 weeks , everthing will be before you inshaullah.

Hey Saki,
appreciate all the help....

have one question for you or anyone who knows this,

On the initial application to CIO, i have stated 17 years of formal education, however during my masters i had the option of lateral entry for which i completed 2 semesters (out of a total of 4 sems) together and finished my masters in 1.5 years. This would total to only 16.5 years of education.

need to know if this would be an issue...

thanks

hi gavi,

what was the actually length of the course 2yrs? From your question i understand that u finished masters 2 semester earlier then whut u expected. This should not be a problem as the total course length was 2 yrs but u finished it early so u will still get the complete time. See some students fail their courses and finish their graduation in 5 yrs but it does not mean they have done 5yrs of studies, it will still count as normal 3 or 4 yrs bachelors :)

dont worry it wont be a problem.
