Hiyvetteyo said:Hi,
I'm not sure this waiting game is good for my health!!!
Our application was received on 16 April in NS with Buffalo as the processing office....no confirmation of receipt or request for next stage although reading other posts it looks like it should be very soon (holding my breath!!!).
Question is this...I have a 2 year work visa which expires on 5 December 2010, if i get my docs back and confirmation of processing before then do i still need to make another temporary residence application? I have read somewhere that the 'pending processing' status is enough for us to remain but i cannot find it again (typical!). Does anyone know if this is correct or i was imagining things!
Oh, another one....can somebody who 'is in the know' post a list of abbreviations and their meanings if possible.
Thanks, and good luck everyone.
Yvette
My husband was in the same situation back in 2008 and so I am giving you the answer based on the rules that were applicable then. You can contact CIC on there toll free number and get a detailed answer to you queries.
In the case that you get the confirmation of processing before your work permit expires you dont need to apply for a new WP. As you can stay in Canada while waiting for the application to be processed. But you can not leave the country and reenter it on the basis of application in process status. Also while leaving the country you need to get a transit visa which allows you to travel back to your home country.
Also you can apply for the work permit even after your current WP has expired but you need to do this before 30 days of expiration.. if you apply within 90 days of expiration of your workpermit you need to provide a detailed justification for the delay and then the concerned authorities take the decision.
If you apply after 90 days of expiration of your current WP then you need to be present for a hearing at the CIC office and you need to personally explain the reasons for delay to the CIC officer.
My husband applied 45 days before his WP expired, he did not get it before the expiration date. He stayed in Canada for about 40 days after the expiration then he got a transit visa came back to India and got one from here within 6 weeks.
I hope this helps.
