Hi All,
My current visa in Canada is expiring in two months time. My Partner and I already applied for family sponsorship in October 2012 which CIC already acknowledged receiving. Do I still need to renew my current visa before it expires or the Spousal sponsorship application sent in ealier already covers my stay in Canada even after the expiry of my current visa.

Yes, you need to apply to extend your visa, applying for sponsorship does not leave you with a valid status in Canada. It costs $75 to apply to extend it and takes about 100+ days to process, you should make sure you apply at least 30 days BEFORE your visa expires. Once you send off that application you will have what's called "implied status" until you hear an answer back, which means even though your visa is expired, you are still legally allowed to be in Canada.

You will be on implied status if you submitted an open work permit application with your family sponsorship. My friend had the same situation and he just presents his AOR letter whenever he needs to prove he is on "implied status" (he renewed his passport with Philippine embassy) and when he had to take a police clearance from Edmonton. His work permit expired while his application was in process. He is now on passport request after AIP.

If you are applying inland, this would be the case, but people who apply outland can't apply for an OWP with their application.

Thanks guys,
Extending my visa now, will make it the second time am extending my visitor's visa. I hope this wont be an issue. I didn't apply for OWP with my spousal sponsorship application, can I still apply for it now (To avoid extending my visitor visa a second time) and send it in as part of the initial spousal application or its too late for that?

Don't you get Implied Status from applying for family sponsorship in-land? I'm pretty sure some of the senior members (Sweden, Computergeek) have posted about this before...

I'm on a work permit that expires in June and am submitting my PR application this week. I will apply for an extension for my work permit in April/May after I get my AOR, but if I'm denied a work permit, it doesn't mean I have to leave the country...I'm applying as in-land so I'm under Implied status until I get a response about my permanent residence.

Multiple extensions is not a problem, it's fairly common for people who are able to be in Canada to stay with their spouse while they wait for the application to process =) Good luck! Oh, and I'm not 100% sure about your OWP question, I think it depends on if you have applied inland or outland.

And to CANUSA31, yes, that is true for inland applications as far as I know, but I'm not sure you would have to check with one of the pros around here. My application is outland so I haven't experienced the process at all.

Haha, definitely! I sent my application in August, and the only reason I know the stuff that I do is because of this forum. This process so far as been the most confusing and difficult thing I've ever done, but I know it will be worth it in the end =) Good luck to you as well!

Filing a PR application does not give you implied status. This piece of wrong advice gets repeated constantly on this board. CIC has a policy of not removing out of status inland applicants so people seem to think this means they have implied status. For Inland applications, it is most common to file a request for an open work permit to get implied status. If you have filed inland and become out of status, you rely on CIC's policy not to remove otherwise eligible inland applicants. I guess it all comes down to the same thing as you are correct in that it doesn't mean you have to leave the country.

Thank you so much! but i cant find the right one. is it IMM5257? Because i have to write a date how long i will need this visa and who i want to visit. but i already live here and i just need it for the time between my visa ends and permanent resident....help! :)

wow, am learning a lot from this form. I will just find out if I can still send in OWP with the submitted PR application, just so I can start to work when its issued instead on being dependent. Raising a family on one person's income can be challenging.

Do I need LMO for renewing OPEN WORK PERMIT?

Hey there, I need your insights. I obtained my OWP along with my first stage of approval of permanent residency under family class sponsorship last Dec.2012 however my OWP expireson July 2013. I am wondering if should I apply for extension yet? And Do I need LMO from an employer upon renewing that? Or just file an extension with my PR application number.

Also, can anyone tell me how long should I roughly wait after first stage approval. I have done my medicals already for my PR as the immigration asked for one.
