Vacation while Sponsorship is on process.

Hey guys, I already asked this question and someone already gave me an answer that as much as possible you can't go out of Canada if you're sponsorship is on process as PR. But this morning I tried calling CiC and ask them if that's alright but what they told me is it's fine as long as I wont be gone for long like until my PR gets voided or something like that which is I believe close to a year. This December I'm planning on spending the holidays with my wife and will stay for like 6 weeks. Any of you went on a holidays for more than a month while your sponsorship is on process? I already got SA btw. Thanks!

According to your post dated 26 June 2014 you applied outland. In that event you are free to be away as long as you like. The rule preventing you from leaving Canada only applies to inland applications so far as I am aware.

OP is a Canadian PR currently and is sponsoring his wife from India, so you're correct if he was asking about his wife, but he's asking if its okay if he - a current PR holder applying to sponsor his wife - leaves Canada for an extended amount of time.

Oh ok, Yes it's outland and our application was sent in Manila VO like in the first week of September. I was just worried that it might affect our application but I see that's the case that it will only affect it if you're and Inland applicant. :) Thanks mate!

Hold your horses for a minute. I did not realize, as MizAngel did, that you are a PR-sponsor. In that event what I advised may not apply. I do not know enough about sponsorship by PRs to advise you. So far as I am aware the requirement is that as a PR-sponsor you must live in Canada, which means that the longer you are away the greater the risk that CIC will say that you are no longer living there. Try and get advice from a more experienced member of this forum before you do anything about your visit abroad.

My advice to the OP. Treat the absence as if you are going on vacation. Most people tend to go on vacation for about 3 weeks at most. Going beyond that, could risk CiC's evaluation that you are no longer living in Canada.

Agree with the previous post 99%. Seeing as it's Philippines mind you, I would risk four, 4 weeks that is. For ME, beyond four is starting to be a stretch in terms of the word "vacation".

Weird as I phoned in CiC again for the 2nd time and they told me that it's fine to go out of Canada even if you're PR as long as ill be back here before my PR gets voided. Not sure if shes understanding my question though but the first time I phoned them it was the same information that was given to me.

By their logic, it means you can leave Canada for 3 years so long as you maintain 2 out of 5 years and yet able to sponsor as a PR? That's doesn't make sense especially when PRs are expected to remain in Canada while they are sponsoring a family.

That's what I've got from them, I even phoned twice just to make sure and I got the same information from those 2 people that I talked to. I guess it wouldn't really be a problem just as long as it's an Outland Application. I would do more research and will try to ask a different forum. But any further answers here would be appreciated :)

A week or 2 here and there isn't going to be a problem. The issue is that the OP, a PR, wants to be out of Canada 6 weeks straight while PR sponsorship is in process.

I don't see any issues with taking a 6 week long vacation.... I took a similar one while my application was in process (I'm a citizen tho).... b sure to keep all ur boarding passes n take tons of pics so when u get back u can submit all that info as proof of ur ongoing relationship... so go ahead n enjoy ur time with your spouse.... this long distance thing can b so difficult on a young relationship!

The issue isn't a problem if you are a citizen. As a citizen, you get the perk of being able to sponsor without the requirement that you must live and remain in Canada during the entire PR sponsorship.

PR must live and remain in Canada during the process whether it is done inland or outland. Most people can go on vacation for 3-4 weeks straight although few people actually do this considering that they are likely using company vacation time. Most company vacation policy only allow 3 continuous vacation weeks. CIC and CBSA are aware of this. So once a PR leaves longer than 4 week max, they can question the validity of PR's claim that they were on vacation for that long in middle of PR sponsorship.

Dang I don't know what to do, I'm not sure of those 2 Reps from CiC understood my question as they told me it shouldn't be a problem. Is there like a written rule from CIC that really says and outland application as PR would not allow you to travel outside a canada for more than a month or something like that?
