Hello!

I am Canadian, my wife is American. We are currently BOTH living in the US. We are planning on moving back to Canada. I've been on the CIC websites but am still a little confused on a couple of details and anyone who could help would be great appreciated.

To do an out land sponsorship, is it better or faster if I move to Canada first, and sponsor her while she is out the country? As an American, will it take her a long time to get approved? Can she work in Canada while the out land sponsorship is being processed or does that negate it being out land?
-I also saw that I can sponsor her while were BOTH living in the US? We just have to prove that we will move when we can get approved? Does this mean rental applications and job interviews?
***I'm also self-employeed, and as her sponsor, I need to prove I can take care of her, this another reason I thought about moving first, and getting set up, but obviously we don't want to be apart.

For the inland sponsorship: Can we just move together, me as a citizen, her on a visitors visa? then as were living there, start the application, then she can apply for an open work permit? or does that take even longer?

Apply outland. US applicants get through the process in a very short amount of time, compared to the 2+ years it takes for inland.

As a Canadian, you can apply to sponsor from the US. There is no work permit associated with outland, but she can come to Canada as a visitor.

Other people with more experience will most likely chime in on this but this is what I think!

I would definitely apply outland! Way faster especially since your wife is american! I think you are looking at roughly a 6-7 months process if I am not mistaking.

Just stay in the US while the application is in process, seems simpler that way. You just need to show that you will move to Canada once the application is successful.

Ok out land seems to be the better option,

but how do we prove that we will move when we get accepted? Or rather, what is the best method of proving intent to move?

Also, as some one who is self employed; will it be hard for me to prove that I can take care of my spouse when we move if my business is in the US? Should I move early and set up shop so I'll have steady income?

-Will it effect our application if I file the sponsorship from the US, but then move to Canada during the process?

How to how intent of moving: job searches, apartment/house searches (even if you don't intend on applying or buying those specifically), letters from friends or family confirming that they are aware of your plans etc..

Also, there is no income requirement for you to sponsor your wife, if there is no children involved.. Is that the case? As long as you are not receiving welfare from Canada you should not have any issues

We have no children, so I didnt know there wasn't a financial requirement. So then both of us will just have to prove that we will get jobs and that we'll move when we get approved.

I am just not sure if its faster or easier if I go there first and sponsor her and have a job/apartment already instead of trying to prove all that in the application.
we're just trying to come up with a time line. I've been reading on here before and I've seen as soon as 4 months or as long as 10 months for american spousal sponsorship. (out land.)

Personally I think you should stay together in the US. Just continue living your lives the way you are now until approval. I don't think it will move the application faster if you go to Canada before her. Try not to complicate things ;)

I am currently living with my husband in Guatemala (where he is from) and doing everything from here. There is no way I would go live in Canada without him :p

The only reason I would move ahead of time would be to set up my business. If we move together, I'll have to start from scratch right off the bat and wouldn't be making much income. but I guess she can work with PR status!
But if I started an application in the US, then moved to Canada during the process, would that mess up the application?

Iguess you're right and we should just keep it simple.

There is no income requirement if there are dependent children. The income requirement only applies if the applicant has a dependent child with a dependent child of their own.

I don't think it would affect your application.. You would just have to update your contact info (address) with CIC. Good luck!

does anyone know the current average wait time for an american out land sponsorship? How long do they give you once they notify you to move?

US Outland "officially" takes 14 months, 29 days of that processing the sponsor's app. That's the time it's taken for them to process 80% of the applications. That number has dropped from 16 months earlier this summer.

Unofficially, I'm seeing apps taking only 2 1/2 - 6 months at most for US Outland. It seems to be getting faster all the time.

For most US citizens, you don't get a passport request. They send a document called a Confirmation of Permanent Residence (CoPR). They usually have to be validated by CBSA at a land border or an international airport. They're usually valid for a year after the date you received your last immigration medical exam.

Are they sending a card too? Like a PR card and number?
Or do we need to go somewhere like an office after we move up? Do you know if she can start working right away as a PR?
I guess I'm asking what happens when you're approved? You just show them the document at the border when you're moving in?


In your opinion, do you think it's wise for me to move back during the application process? updating my contact information going to slow anything down? Or should we just stay put and wait?

Yes, they will send the COPR and you can move to Canada. When entering, you inform CBSA that you are landing as a PR. They will send you to secondary where you wilL meet ith an officer to process the landing and become a PR.

The PR card will be mailed a few months after landing.

There is no need to go to an office for a PR card.

She can start working as soon as she gets a SIN.

Moving to Canada during the process will have no effect on the app.

Does she get the SIN with the PR card? Or can we go to a service Canada and get her set up as soon as we cross the border?

If we did decide to do an inland, she will have to file for temporary work permits over and over again until the PR is approved?
If we're married, is it easier for her to move up there with out a job? I guess I don't understand that you need a work permit to get a job, but you need a job to even apply for the permit, but that could take months, what employer would wait that long?
