Hi Legalfalcon,

Could you help me to understand, who triggers the RPRF req ? is it Agent or VO. i got rprf letter with standard format: profile has been found eligible. Does that mean eligibility is passed. It also mentioned that Security is still ongoing. IMO it's only matter of Security result now. Post that VO will make decision and trigger PPR email. My file is currently in CPCO. BG status is NA (followed by NS).


Based on your experience on GCMS notes, pl comment. Have you seen cases where file got rejected post RPRF.
I may get my GCMS notes in week of 15th May.

Have three points for clarification?
Received ITA at 435 on 5th April...
Now Questions!!!

1. In my EE profile made a clerical error by mentioning IELTS Refrence Number & Date of Result as 23 Dec 2016. While filling my eAPR, I realized the mistake & have entered correct number mentioned on IELTS TRF & Date of result as 22 Dec 2016. Will this be the reason for Rejection if I submit my Application, if it can be, Should I reject the ITA & enter pool again, wait for 3rd May draw at 435 CRS??

2. I have about 6 years Experience with three Employers , Now One of the employer mentioned in EE profile that amounts about 18 months of Experience, is not providing Refrence Letter in the CIC format, But I have all other supporting documents like Standard Experience letters, Pay Stubs,Email from HR that they cannot provide the CIC format letter, etc. If I remove this Employer from my Work History & transfer it to Personal History. Will it cause a rejection(this employer NOC code is not as primary code for my Eligibility)

3. For proof of Funds, My father transferred the required amount in my account in April post ITA supported by Gift Deed, Affidavit, His Net worth certificate etc. The account he transferred money into was not having any balance for the last 6 Months as I am living abroad & not using that account as my primary account. Should this POF be accepted by CIC???

Need suggestion basis the three scenarios above, Should I reject my ITA & enter pool Again at 435 CRS or Submit the application with LOE??

They can try applying for a visitor visa, but it will be difficult. It will be better if he goes as a student, which will give him a better chance and also open doors for him to get a PR after his program.

If you have received the RPRF, your eligibility is cleared and the chances of rejection at this stage are very rare. The RPRF is triggered by the office which conducts your eligibility check, it could be the LVO or the CPC, depending who has been allocated the file. In most, but not all cases it is the CPC, and then the file is sent to LVO.

No, not an issue. Add a Letter of explanation.

The maximum points you can get for international work ex is 3 years. If you have 3 years from other employers that you can prove you are good. But, I would suggest that you keep this on your work experience too, and add letters from your former colleagues, supervisors, IT returns etc to prove this. The worst case is IRCC will not take this into account, but if your other work ex is in issue or an document is incomplete, this will help you. So get the letter from your employer and substitute it will letters from colleagues, supervisors etc.

Yes, as long as you have the gift deed, you are good.

Based on the above, I would say, accept the ITA and file your application.

1.I was thinking the visitor visa of son will be approved on humanitarian and compassionate base, he has already plan if he gets visitor visa then he will apply study visa there.

The non-immigrant visas are scrutinized on the basis that the applicant will return to the home country after the purpose of his stay in Canada (study, visit etc.). Then additional conditions play a role as in, does he have family in Canada whom he is visiting, the relationship with the family etc. But, all these factors are subjective and will depend on the visa officer looking into the file. Now that the parents are PR in Canada, this is a strong sound for a child to visit them, but they have not landed and will be unable to show that they can take care of his basis needs during the stay (medical boarding & lodging). Under these circumstances the likelihood of refusal are high.

The Humanitarian and compassionate (H&C) grounds are rarely looking into while giving visitors visa or study visa. H& C grounds are usually looked into in deciding removal, refugee, etc.

With the limited information, I cannot give more details. Your case is very factual and you should engage an immigration attorney who can file a strong application for you and see how things go. If you would be interested I can refer you to a friend of my who is a licensed immigration attorney, and he will be happy to setup a consultation and see what are the best ways for going ahead.

Yes, it is possible to pass R10 before passing Medical. This is because R10 is a completeness check, which only looks into if an application is complete, where as medicals, like eligibility are further looking into the information. For some applicants the R10 and the Medicals pass at the same time, for other one happens before the other.

There is no set number of days within which the file is transferred to LVO. It all depends on the location of LVO, the case load on the LVO and the number of applications being processed at the LVO. In some cases the file is transferred immediately and the BGC happens at the LVO. For others, the BGC is done at the Case Processing Centre (CPC), and then the file is transferred on for the PPR. The only sure way to know when the file is sent to LVO is through GCMS notes.
