Dear Legalfalcon,

Please help me! kindly have a look on the GCMS's Notes (sent as PM) and suggest what should I do now? Actually the Case Analyst have not mentioned my current employer's experience /name which consist 8 years of experience.

My Background is "In Progress" from 7th May 2016. I ordered my GCMS note on 18th May and received it 17th June.

There are total seven notes in which three Notes are written by Case Analysts. Note no. 3 & 4 are very pathetic, but Note no 2 seems positive and Note no. 1 (the latest one) shows that my file is in local visa office now.

I have sent my GCMS note's contents, kindly check your Inbox.

I am waiting for your kind help, please.

Regards

Hi legal falcon

I have File under processing in Quebec province.

at the same time, I applied for SINP under occupation in demand program ?

what are the chances to get approved from SINP? did they reject people who have files under progress in other provinces?

please advice

Hi LegalFalcon,

I would like to get your advice on the below scenario, I have been referred by promax. Another user Mr. Raj provided me this link
"http://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/section-186.html".

As per the above link,

"186 A foreign national may work in Canada without a work permit

(v) if they are the holder of a study permit and

(i) they are a full-time student enrolled at a designated learning institution as defined in section 211.1,

(ii) the program in which they are enrolled is a post-secondary academic, vocational or professional training program, or a vocational training program at the secondary level offered in Quebec, in each case, of a duration of six months or more that leads to a degree, diploma or certificate, and

(iii) although they are permitted to engage in full-time work during a regularly scheduled break between academic sessions, they work no more than 20 hours per week during a regular academic session; or

(w) if they are or were the holder of a study permit who has completed their program of study and

(i) they met the requirements set out in paragraph (v), and

(ii) they applied for a work permit before the expiry of that study permit and a decision has not yet been made in respect of their application.

Hi,

Did anyone get PR showing the work experience gained while waiting for PGWP under CEC class? Please share your experience.

I received ITA. I am working on my documents. Mr. Raj asked me to consider the factor of "discretion of the officer". So I am interested in hearing from other users. Who might have underwent the same scenario as mine.

- I received degree completion letter from University on 23-Feb-2015
- I applied for the post-graduate work permit (PGWP) online on 24-Feb-2015
- My study permit was valid till 31-March-2015. From 1-April-2015, I was on implied status till 7-May-2015
- But the date issue of PGWP is on 8-May-2015
- I received ITA on 1-June-2016

Scenario1:
Job1 : Company A
Status: Part time
Duration : 1-Mar-2015 to 08-Aug-2015 (PGWP issued on 8-May-2015)
Total weeks: 23 weeks (I have been told that 18hrs/30hrs=0.6, 23 weeks*0.6= 13.8 full-time weeks)
Hours/week : 18 hrs
Total hours : 23weeks*18hrs=414hrs

Note: 09-Aug-2015 to 16-Aug-2016, I didn't work.

Job2: Company B
Status : Full time
Duration : 17-Aug-2015 to 1-June-2016 (I received ITA on 1-June-2016)
Total weeks : 41 full-time weeks and 3 days
Hours/week : 37.5
Total hours : 41.3 weeks*30hrs=1239hrs

Job1 (13.8 full-time weeks) + Job2 (41 full-time weeks) = Total (54.8 full-time weeks and 1653hrs), In this case, I completed 1 year.

Scenario2:
Job1 : Company A
Status: Part time
Duration : 8-May-2015 to 08-Aug-2015 (Start date as per PGWP issue date instead of actual job start date which is on 1-Mar-2015)
Total weeks: 13 weeks and 1 day (I have been told that 18hrs/30hrs=0.6, 13weeks*0.6= 8 full-time weeks)
Hours/week : 18 hrs
Total hours : 13weeks*18hrs=234hrs

Note: 09-Aug-2015 to 16-Aug-2016, I didn't work.

Job2: Company B
Status : Full time
Duration : 17-Aug-2015 to 1-June-2016
Total weeks : 41 full-time weeks and 3 days
Hours/week : 37.5
Total hours : 41.3 weeks*30hrs=1239hrs

Job1 (8 full-time weeks) + Job2 (41 full-time weeks) = Total (49 full-time weeks and 1473 hrs). As per sceanrio2, I require 3 more full-time weeks. Then I will complete my 1 year only on 20-June-2016.

When do I complete my 1 year of Canadian work experience?

Can I accept the ITA which I received on 1-June-2016 or not?

I explained my above scenario to a lawyer and she told me that she can only give legal opinion on it. If I am not full-time student and also I am working legally (i.e. with a valid study permit and also applied for the post-graduate work permit) then my experience (in the period of 25-Feb-2015 to 7-May-2015) should be eligible for 1 year of Canadian work experience.

With the excerpt you have provided it seems that your medicals were asked to be re-examined or reviewed which took time. I cannot comment much without looking at the entirety of the notes. If you would like I can look into your notes and get back to you if you can email me your notes.
Ok. will do. my AOR was December 9.

Hi,

2nd Scenario must be used to count 1 year canadian experience. I would suggest wait for 3 week and then submit your documents so that you have completed 1 year work experience after receiving your work permit.

What do you mean by "File under processing in Quebec province?" You can apply to multiple provinces, but you can only accept one and have to reject the other. So if you have applied to Quebec and Saskatchewan, that is fine, but when you receive a nomination, accept one and reject the other. You will also lost any application money that you may have submitted. I have not looked at the recent forms, but if in the form it is asked have you applied to another province, you will have to answer yes to that.

Hope this helps!

(ii) they applied for a work permit before the expiry of that study permit and a decision has not yet been made in respect of their application.
"
Just to make things simple, here is the correct interpretation of law is in the same link that you referred to:

Paragraph 186(w) of the Immigration and Refugee Protection Regulations allows students who have completed their program of study to work while they are waiting for a decision on their work permit application as long as they were a full-time student enrolled at a designated learning institution in a post-secondary academic, vocational or professional training program, and they did not exceed the allowable hours of work.

So your work done between you applying for the PGWP and the day you received the decision is valid and will count towards your Canadian experience.

I have not calculated your scenario A and B. If you may have any further question, feel free to ask.

Hope this helps!

If you are referring to a ghost email, it takes 24-48 hours before you receive it. You will not get any email stating that your BGC has started. Its is just a ghost email and most people receive it. Even if your don't get it, it is not a big concern and not a big deal.

BGC is conducted by external agencies, and no one can determine how long will it take. Usually it is 3-5 weeks. To have an in-depth understanding of the different stages of the application process, you can read my earlier post here:

Hi there, I've started working full time since August 11st, 2014, typical 40hrs / week. I woke up this morning to see my CRS has increased from 446 to 460 as a result of a 2 years working experience. Am I allowed to claim these points? since based on my calculation, my 2 years should be on August 11st this year. Or they calculate based on my working hours?

It is the time, not the number of hours. If an applicant works 80hr/week, he cannot claim 2-year work experience when he has only worked one. So technically you will be finishing your 2 years of full-time work experience in August 2016.

BGC going in progress is no indication that the PPR is on its way. Although, it's a good sign that your application has progressed to another stage, which takes the longest. However, some applicants see BGC go in progress and then to not needed at this time. Its all over the place. I will not too much into it. If you have not yet ordered the GCMS notes, you should do it. The notes are the only sure shot way of figuring out where your application is.
