Dear Legal Falcon,

I am lawyer from india. My wes says that i am equevalant to Bachelors of law (4 years)
Now my questions is that whether i will be considered as a bachelor degree holder or under the head of master or licensed professional program in cic. My score is 471 if i consider myself as licensed professional and if i change it to bachelors degree than the same would change to 430. The cic says that law is a professional licensed degree. Plz help. Following is the concerned link.

I received my GCMS notes today,

on the page 2 its says
Eligibility : passed, updated date 2016/07/15
Criminality passed

Medicals: In progress

and in the notes : updated on 2016/07/12
review Type Case Analyst: I have verified the application under section 11.2 of the IRPA and make the following determination: Recommendation ***Review required by officer***Settlement plan requested Ready to Finalize____________ Civil Status: PA in status WP until 2017-01 Work Exp: Qualifying period from 26th May 2013-25 May 2016 which is assessed as follows : The duties listed in the reference letter appear to be consistent with the actions in the lead statement under the NOC selected. The letter of reference appear to be consistent with a substantial number of the main duties under the NOC selected. The letter of reference appear to demonstrate that PA met the minimum requirement of 12 months of work exp.

So it says says Eligibility Passed though it still needs to be reviewed by an Officer?

Yes, you can submit your EE application without the FBI PCC. Make sure you add a letter of explanation giving details of when your sent your documents to the FBI, a copy of the dispatch receipt, a copy of the received signature from the FBI. The CIC is well aware of the delay caused by FBI in issuing PCCs. They will give you additional 60 days to furnish the FBI PCC which is more than sufficient.

Since you have received your PPR, the 10 days won't hurt you. Just make sure you land ASAP.

The eligibility check is a two step process. First, an analyst checks and reviews the submitted documents. However, his conclusion is not final unless an agent agrees with him. The Agent's note which confirms of differs from the analyst's note is the second step and only after this is the A11.2 finally met.

In most cases the Agent does concur with the conclusion reached by the analyst, i have only come across 2 cases where the Agent had a different view, but those cases were complicated.

In conclusion, until you have both the step one and two, you won't see Eligibility - Met / Recommended Passed / Cleared.

Though, Law is a professional or a licensed profession, but unless your WES report says so it will not be considered as one. If the WES report does not mention that your law degree is a first professional degree to practice a licensed profession, CIC will not give you points under the Master's / Professional degree.

You should send an email to WES and let them know that your degree was sufficient to award you a license to practice law. I have seen other applicants get WES reports where their Law degree is equivalent to a bachelors degree, but under it they wrote, first degree to practice in a licensed profession. You should also get the same. Until you have it, you won't be able to get the score for the professional.

But if u see the link i attached tonmy query, it says assessment of law is through bachelors of law. And my wes says exactly same.
One more thing my wes report 2 years old. Can i now right an e mail to them for clarification.

Hi legalFalcon.

I read your extensive post on the process of background checks.
But I am still a bit confused about certain things.

Does background check include calls to the employers and the bank for work and POF documents or is it done earlier after the AOR.?

I received my AOR in March . I m a FSW Outland applicant. My bg check went from in progress to not need in March. Then in July, it again went back to in progress. Does this have any signnificance?
