Spouse Sponsor - how to apply from within Canada

Hi all,

I am planning to come to Canada in the near future (in two months) and get sponsored by my wife (canadian citizen) under the family sponsorship visa (holding Italian Passport) http://www.cic.gc.ca/english/information/applications/guides/5289ETOC.asp

As far as I ama concern there are two options for that:
- application from outside Canada
- application from within Canada

My wife and I would prefer to apply within Canada, so she can move right away closer to her family.

Under this type of visa, we are a bit confused on what are the right steps in terms to "moving to Canda"...

We have been living around the world for some quite time (Dubai, Australi, Italy) and now, while returning we are concerned on "what we say" at immigration....

do we say we are visiting family? do we say we are moving there and then we will apply for sponsorship?

she is very concern on what to say to avoid issue during the sponsorship....

ideas? suggestions?

Yes pretty much. You should enter as a visitor/tourist, meaning having a return flight dated less than 6 months later and avoid using words like "move" or "live".

Once in Canada, you can then apply for PR along with Open Work Permit using INSIDE CANADA method.

We have been living around the world for some quite time (Dubai, Australi, Italy) and now, while returning we are concerned on "what we say" at immigration....
Note you will need to get police records from every single country you've stayed in 6 months or longer.

Works like a charm :p I will get a return flight just for this purpose... I guess I might also be careful on not "carrying too many documents with myself LOL

how long do the police certificate last for? As far as I am concern, in Australia, for example, a police certificate cannot be more that 6 months old... and in this case I cannot get the now (while outside Canada), because when I would need to provide my documents they most likely be expired...

actually this is an interesting topic.... do you submit all required documents at the start of the application or at the end?

Finat76, have you considered getting an IEC visa? I think Italians can get it for 1 year and I don't think you need a return flight home.

My husband is entering Canada on a 1 year IEC visa too and during this time we will apply for inland spousal sponsorship.

I have a thread on what to say at immigration, you should check it out as there were some helpful responses!

I think the old rule was 3 or 6 months validity, and seem to recall newer rules allowing 1 year validity. Again though, not entirely sure and couldn't find confirmation on CIC site.

We couldn't either so we didn't take the risk...my husband was pissed though, doesn't really make sense since he'd never been back, but better safe than sorry! :)

So to me this means this wouldn't expire (after all you couldn't commit a crime there if you never returned to the country), but again I'm not sure how IRCC interprets this.

I am not entirely sure abut this... I guess you could "potentially" commit a crime and leave the same day... and one day later request the police clarence... -> assuming you have not been caught, you police certificate will be clean.... but maybe, few months later, the investigation find you guilty.... you are not living in the country, and your police clarence certificate will now be "dirty"... this is the main reason I thin 3 or 6 months validity makes sense.... (BTW, in Australia every police certificate last for 6 months.... ) I guess I better wait for the time they will ask the certificate and request them to Italy, Australia and Dubai then.... am I right assuming they generally ask police certificate at the very end of the process?

thanks for this... I have checked, but unfortunately this category, for Italians, is limited to work in holiday visa and I am a few years older than the required age of 35 ;)

I guess I can still look for a job and potentially get the employer sponsor my work permit... no?
