Annulment document should be enough evidence that he can marry you legally in Philippines.

If for some reason his annulment is not valid you will need to get married in another jurisdiction where your marriage would be valid...

His divorce is valid in Canada, and he could marry you In Canada without a problem,

But if he did not got the annulment then his divorce in Canada is not valid for immigration purposes if he marries in Philippines,

hi, it depends of what another proof or documents anong gusto nila, base of my experienced, ppr ko and another documents for my son, then later after 1 month my medical was about to expire so they requested me for re medical, basta pray and comply ninyo lang, matapos din yon, tagal nga sa akin at least DM na ako, so thankful din..

I received letter from embassy regarding our application it says that I may not meet the requirements for immigration to Canada.

Subsection 1 of the immigration and refugee protection act states that A foreign national may be selected as a memberof the family class on the basis of their relationship as the spouse, common law partner.child.parent and other family member of a Canadian citizen or permanent resident.

Section 2 of the immigration and refugee protection regulations states that marriage in respect of a marriage that took place outside Canada means a marriage that is valid both under the laws of the jurisdiction where it took place and under canadian law.

Your sponsor was married to another on February 2003 in the Philippines..He obtained divorce in Canada and rendered on August 2007. You and your sponsor were married jan. 2011 in the Philippines...it would appear that your marriage to your sponsor may not have been conducted according to philippine law.specifically yourn sponsor is a filipino citizen at the time he obtained divorce.

This letter is being sent to you to offer you an opportunity to respond to this concern and to afford you an opportunity to supplement your file with additional information. Before a final decision is made by an officer..you may submit written explainaction or your sponsor may provide annulment documents or any other documents you would like to submit within 45 days upon receiving this notification......etc..

Please..I need your help... aside from the annulment docs.which I have..anything else that I can give the embassy for me to have a positive response ..We submitted our application last September 2011... gusto ko po kaseng maka gather ng mga best idea nyo po bago kmi mag submit sa embassy pra siguradong ma approve na kami ..thank you so much po.

hi base of my experienced, I was working in local govt. office. if your husband is a Filipino divorced in Canada but not annulled here in Philippines, he can't marry you. I have my friends working in local civil registrar, I was always asking them about because I was in annulment but if he is a foreigner who married in Philippines to a filipina but divorced in his country, he is allowed to marry a filipina, the local civil registrar won't allow you to marry if a Filipino who is now a citizen to other country and who have previous marriage here that's not yet annulled, please tell your Filipino husband who is a Canadian citizen now that he need to annul his previois marriage because that is our law, we need also to comply our Philippines law, embassy will really investigate much, even other didn't declare their children but through investigations, the embassy still will know it..thanks

Basta sis, I'm not sure why you got married to him na Hindi man yan pwede di ka man rerelisan Jan ng marriage license, sa law natin if we are Filipino who married here then divorced to other country and come back again here to marry another di pa na annulled ang previous, kasi Filipino tayo but yong mga foreigner kahit my previous marriage as long divorce sila sa kanilang country pwede sila kasi Hindi sila pinoy, yon ang alam ko...so better ipa annull mo muna ang previous niya..annulment din ako and thanks God through my prayer all is well...one year lang annulment sis, medyo mahal talaga, just keep pray things will be fall into places <3

Annulled naman po sya, as per her last statement and i quote 'aside from the annulment docs.which I have..anything else that I can give the embassy for me to have a positive response'.

Anyways, to bygrace, when po nag pa annul yung spouse nyo, if i may ask? Did you attached a copy po ba ng annulment papers nya dun sa application nyo?
It would appear kasi sa letter ng CEM parang walang annulment document na naka attached.

And if his previous marriage was annulled before pa kayo ikasal, wala naman kayong magiging problema dun. Need nyo lang ipresent ang facts sa CEM.
But if ang annulment eh after ng marriage nyo, malaking problema po yun, so much better consult a good immigration lawyer na lang po if that is the case. Good luck and God Bless

Yung details mo lang po ang dapat ilagay sa Appendix A. Nde po pwede ilagay ang parents or kapatid or pamangkin kasi nde naman sila kasama sa application mo.

Spousal sponsorship and walang dependents, di po ba? So yung details mo lang and ang passport mo ang ipapadala. Family member(s) refers to spouse, which is You and children, if any.

Dont worry po, tama po yung ginawa nyo. Ang Appendix A po is fini- fill up lang po upon PPR na. I think just to make sure na updated yung Passport details and ang address mo kasi dun nila ipapadala ang PP and visa later on.
