hi everyone! i just received a letter from the embassy saying i do not appear to qualify as a member of the family class per section R117(1)(h) of the Regulations -- my sponsor, who's my aunt/ mother's sister, got married in 2010. my application was submitted in 2009 when she was still single.

now the embassy is giving us 45 days to provide any evidence or submission to address the above stated concern. if they receive no correspondence within 45 days, my application will most likely be refused. they already have my passport, medical exam results, etc.

my aunt says she will consult an immigration lawyer in canada. we don't want our money, time and effort go to waste.

has anyone here been through the same situation? i need your help. thank you in advance.

Based in OP2 regulation - Sponsors who do not have a living spouse or common-law partner, conjugal partner, a son or
daughter, father, mother, grandparent, brother, sister, uncle, aunt, nephew or niece, who is a
Canadian citizen or a permanent resident, or any relative or family member who can be
sponsored as a member of the family class, may sponsor one relative regardless of age or
relationship (anyone connected by blood or adoption).

It seems your Aunt's status now as married has affected your application... If the application has a lock-in period in relation to the previous status of the sponsor then I would suggest that you send a letter to CEM explaining that your application was filed when your aunt was still single. In addition to the letter that you will send, you can attached a copy of Aunt's marriage certificate or any document that will show the date when she got married. ;) ;)

Hi everyone! I'm so desperate to know the answers to my questions. Have visited Canada's consulate website but still confuse! Wondering if anyone out there who could help me. Sincerely appreciated! My questions are 1) is it possible for me up apply for a work permit in Canada while here as a tourist visa?2)same employer I have worked for 6 years in Hk brought me here as a tourist can he sign up for me as my employer here in Canada? Sponsor?3) do I have to go back Hk while waiting for the processing of my work permit?4)I only have 32units in university in the Philippines is it possible for me to enter live-in caregiver program?if the same employer brought me here in Canada? The cic link doesn't seem to answer all my questions. Many thanks

Good day!

Thank you and hope to hear from you.God bless

He was advised that his PR card will come in the mail in 4 weeks. :)
