Naku!!!... Mukhang mahirap ang situation nyo... :( IMO you will need an expert immigration lawyer to handle your case.. para i-advise kayo kung anung best direction na gagawin nyo kasi if you did not declare your GF (now your wife) in your application.. it will be difficult (if not possible) to get your wife to Canada. You should have declared your GF as common-law or conjugal relationship when you applied...

May isang case dito i forgot his handle name.. he has wife who used to be his long time girl friend way back in college. He sponsored his wife as spousal but was denied by immigration.. The reason.. the wife should have been sponsored as common-law since they declare the relationship started when they were still in college and not after they got married.

May isang case pa si Jl_pamittan.. her wife sponsored him but his wife did not declare him during her wife application for PR. The reason.. hindi pa sila kasal... but the thing here is nag sama na sila as common-law bago sila nag pakasal at bumalik sa Canada wife nya...

Bottomline... dapat na declare kayo as dependent sa PR application ng sponsor nyo as a member of family class... IF hindi kayo na declare sa PR application ng sponsor nyo.. then.... you will fall under exclusion outside the family class sponsorship... :( :(

117(9)(d) A foreign national shall not be considered a member of the family class by virtue of their relationship to a sponsor if subject to subsection(10), the sponsor previously made an application for permanent residence and became a permanent residence and at the time of that application, the foreign (sponsored person) was a non-accompanying family member of the sponsor and was not examined.

Normally, after CEM received your application they will update the ECAS to show they already received the application... After receiving they will check the completeness of you application... like RPRF, AOM, and Medical result etc... pag may kulang mag re-request sila minsan kasama sa PPR and Appendix A.. After nun... "Medical results have been received" lalabas sa ecas tapos..... long waiting time probably due to background and security check ....then aftern nun may lalabas sa ecas na "We started processing your application on.... " Pag lumabas ito.. more often than not.. malapit na ang DM... ;) ;) ;)

Para in the future ma sponsor mo ang asawa at anak mo..

6 years ago a filipina was deported for misrepresentation ( same case as above). Our mayor even intervene as she works with him to take care of his mother but to no avail. I don't know if they( immigration)softened on this but it pays to be truthful in filling out documents especially immigration stuff. As I said this was 6 years ago and things might changed now and hiring a good lawyer will help.

Hi KMAEP, Sorry for the inappropriate words but your friend's case is a classic case of misrepresentation... If he will continue to pursue sponsoring his family and immigration finds out that he lied in his PR application he may be subjected to removal order or deportation. Worse if he is a citizen already.. his citizenship maybe revoke. :( :(

Hi wolverine,

I think in ur case Kung single Ka pa until the time na nagka decision sa previous application mo, ok Lang un Kung 'single' status ang dineclare mo... Kasi nabuntis and nagka anak nmn gf mo after your visa was issued na. Unless nagsasama na kayo ng gf mo previously, kahit Hindi married, Kung pasok un as conjugal or common law dpat nasabi un sa application. Pero Kung gf Lang talaga ok lang.

For kmaep's friend, I agree with what the others said na may big probability na ma cancel un visa niya Kasi Hndi niya dineclare un totoo sa application.

If Tama understanding ko, sa case ni wolverine, his circumstances changed after visa issuance while for the other one, un na talaga situation niya before pa mag apply

Just my pov Lang po :)

I agree.. kung gf lang noong umalis sya noong May 2011.. I believe hindi misrpresentation yon.. So kung umuwi yong guy at nagpakasal dahil nagka baby sila.

In fact it takes months to process working visa or any visa. So noong pinaprocess ang visa ng guy before May2011 ay baka hindi pa buntis si GF so baka hindi nila alam na magkakababy sila.

Sabi nya po nanganak wife nya august 2012?????or 2011??? Tas nagpunta sya ng Canada ng May. By the tIme na in process yung pr application nya buntis na gf nya. Medyo complicated ang case kasi alam na nyang magkakababy sya habang pinaprocess pa lang application nya at hindi nakadeclare sa application nya yung baby at gf (which can be considered common law). Baka magkaprob sya. He should hire an immigration lawyer.

Bottom line is kung nagsinungaling ba sya (misrepresentation) o hindi. Or honest mistakes within reasons...
