We are about to submit my application, but I’m scared, my husband is filling NO that I wasn’t previously married because the man I got married to then was a married man technically a polygamous marriage which is legal in Nigeria, I’ve also used this man’s name before on my NYSC certificate plus when I applied for a US visitors visa then I told them I was married to the previous man. I’m worried if we lied about my previous marriage, CIC will find out, meanwhile I got a divorce paper in July 2019 for my previous marriage and got married to my new husband Dec 2019. Please advise me, what should I do?

I (sponsor, Canadian citizen) have applied to sponsor my partner and our daughter in April of last year. Because I'm a sailor (gone +6 months / year) and we were not married, and I had no resident status in her country (United States) we applied under the conjugal category and our application was refused... My partner and our daughter have now been living with me as visitors in Canada since October, and we are finally engaged and about to marry in the U.S. at the end of this month. We want to send in our application as soon as possible. We already applied for an extension of their visitor Visa and want to send in an open work permit with the sponsorship application. Should we apply for outland or inland? We don't want to loose the possibility of traveling if possible, but could accept it for faster processing times etc.

I definitely thought to pay all fees and have proof of payment before we come back to Canada at the end of the month after getting married.

Any comments are appreciated! I regret not asking more questions here and elsewhere before applying the first time...

Were you born in Canada or naturalized as a Canadian prior to your child being born? If so, she is Canadian and cannot be sponsored.

If you want to apply for an OWP, you need to apply inland. Also note that inland requires you both to continue to live together in Canada throughout the entire process, so you can't leave for work. It also generally takes longer than outland. Outland apps for Americans are generally faster.

Technically, the first marriage isn't legally recognized by IRCC because polygamy isn't legal in Canada. However, you should NOT lie about it. You will need to list the name you used before as well. Declare everything in full and include all documentation and a letter of explanation.

Many people apply while not working. You need to show a solid plan on how you will support yourselves in Canada without welfare.

If I apply without working and then find work, is there a way to update my application? Then if I leave that work because of pregnancy, is there a way to notify?

If you have a legal divorce certificate. Why not disclose it? Wouldn't make sense to lie about it. Especially if the divorce is valid. You are now legally married....

You have Negatives and Positives with Both Options. You will have to choose which is Best for You

INLAND: Your spouse will not be able to leave Canada until the application is complete however, they can apply for the OWP with the Inland App. Not sure if your child is enrolled in school or not. However If they're not school age I guess you are ok.

OUTLAND: You cannot have an OWP, they may be able to visit at the discretion of a Border Officer. You may get through quicker...However it depends on how complicated your situation/application is.

It all depends on which situation fits best for you. Keep researching. These are just a few points.

FYI: Inland AND Outland PR applications are now showing 12 months for approval time. Outland can no longer be assumed to be a quicker process, unfortunately.

Posted times for both have been 12 months for quite some time. Outland is still generally faster.

I was born outside Canada (citizenship by descent), so our daughter is unfortunately not Canadian. I never read that we would have to stay together for the entire period, i.e. that leave for work was not permitted. We will be living together throughout the entire process, I will not have another address during my leaves for work... I cannot not work. If you are confident that IRCC will not allow me to leave for work, we will have to apply outland :/

You can certainly leave; IRCC will not stop you. However that puts you in violation of the inland requirement to cohabit IN Canada throughout the entire process, so you could expect a refusal.

Outland is your only option if you have to leave for work.
