Hi all,

I searched for topics that included deportation or ARC and didn't find anything so hopefully if anyone else is out there, shine some light on this.

I'm sponsoring my husband who was deported for overstaying. No criminal record.

I'm wondering when the ARC should be filed or paid?...

My lawyer says to wait for the VO to request .... but i am certain he needs an ARC, and I also know an ARC will take a long time to process too. I want to avoid waiting a year for sponsorship, then finding out I need to do an ARC too and that adds another year...

and i suppose I'll just ask if anyone has successfully sponsored someone who was deported for overstaying in Canada?

Does your hubby have a one year ban or a life time ban for coming back into Canada? If he only has a 1 year ban then no ARC is needed and your application will be worked on, however he needs to wait the year before you will see any action on your file and before he can come back to Canada. If he has a life time ban then he will need an ARC and it will be requested from the VO when it's required

I've looked up the different removal orders and ARC, only departure or exclusion orders have a 1 year ban. My husband was a departure order turned deportation because he didn't leave in the 30 day period.

So I guess it's a lifetime ban.

I don't want to become hopeless, but I'm wondering if anyone out there was successful in sponsoring their spouse and successful in doing the ARC?

Yes, there are several who have successfully sponsored their spouses who needed an ARC. Include the ARC app and fee with the PR app.

I asked about the ARC fee/app and my lawyer replied to me saying that we should wait until we here from the VO.

I think we should have submitted it all from the beginning too. I don't want to have to wait longer than necessary to be reunited with my husband.

My lawyer's response to all my concerns is to "wait for VO to request/respond"

I hope he's not just being lazy =(

I suggest you bypass the lawyer and submit the ARC app ASAP.
