His family for almost 7 years (he was here studying on canada) and talks to them daily on the phone but god forbid sometning would happen to them during the inland application he would not be able to leave to see them
During those 2 years processing time that is another reason we are leaning towards Outland.

Read the whole thing starting from page 1 and go to the last post on the bottom of page 6 where there is a link to another thread in a post from a member named Ponga. In summary (even though there is a lot of back and forth and it is not clear cut) both of these threads talk about the fact that it is still viable to apply outland even if your husband is out of status. There is always a small risk that he may be removed back to Yemen but it seems very unlikely based on the limited resources CIC/CBSA has to track these things and some of the opinions shared by other members.
Right now your overseas visa office (VO) Abu Dhabi is processing outland applicants within 13 months and they can often be sooner. This is after receiving sponsor approval which is currently taking approx. 64 days. The fact that you have 2 kids and have been living in Canada together for so long, I believe this is a risk that may pay off. Not the official CIC or "right" way but if I was in your shoes I would do it. As long as you and your husband have no criminal records then I think you stand a good chance of keeping under the radar while your file is being processed. Make sure though that your husband has not/will not work or study "illegally" while he is out of status. That could jeopardize everything. And do a good job on your application - so CIC does do not have to request anything additional - and pay all of the fees upfront. Then pray!
Also, if you are not working, then most definitely include letters and documents (including specific financial details) from family and/or friends as to how you have been supporting yourselves and how you will continue to do so while your application is being processed. Do not lie on the application in any way, but do not go overboard with details that have not been requested either.
