In order to make a request against the Privacy Act, you both must have status in Canada. This means you must be a Canadian citizen or a PR already and in Canada. Also, your husband must have his OWP already in order to request against the Privacy Act. See: http://www.cic.gc.ca/english/department/atip/requests-personal.asp .

You can make a request against the Access to Information Act if you are in Canada. See: http://www.cic.gc.ca/english/department/atip/requests-atip.asp . The fee is $5.

Additionally, you will have to have him complete the consent form. He fills out and signs section A. You fill out and sign section C. You will also need to be his representative, so if you/he didn't submit the form, you/he have to submit http://www.cic.gc.ca/english/pdf/kits/forms/IMM5476E.pdf first.

When you request GCMS notes, you can ask for Sponsorship application, PR application, and medical notes. All are available.

If your husband has yet to receive his OWP, is it late?? They take about 4 months to get. I wouldn't order the notes until that time, as there will be literally no information on the file yet.

Profiler, come on man. This question is asked often, so at least give the correct information. There is no requirement to have status in Canada, it is only required that if you are not a citizen or PR that you be currently present in Canada, which almost everyone on this forum is. It doesn't say anything about status. You are allowed to ask for notes about yourself without a consent form under the privacy act for free.

Choose the apply online option and follow the steps. I got my notes - I am the primary applicant and applied under the Privacy Act. I didn't pay anything, didn't fill out a consent form. They email the notes to the email address you provide.

I am curious, I am a sponsoring my husband inland. We applied on Dec 8,2015 and started processing in Jan 15,2016 . So basically we have a lawyer I like to know when they ask for PCC in June 2016 that mean I am approve as a sponsor because on line 2 it says in process in all 5 catorgoris and line 3 it says medical results received. he is from a visa exempt country that is Portugal. And it's a good sign now waiting for Copr sorry there is no full stop typing on tablet been reading all post last time we went to his laywer she and her partner was like congratulating my husband and saying our case going good two weeks ago tall to cic and they are like someone working on it some of them log in

However, I 've heard about that kind of "visit" just once while listening to a canadian immigration podcast, they had a guest former CIC officer that now works as an immigration consultant. She said back in the old days it was a common practice but now, they come over only if it's a very bigred flag regarding the relationship. She was talking about a case of a married couple, he was 60 and she was in her early20s, he was some fancy CEO while she's been unemployed her whole life aaaand she's been previously denied multiple types of visas before submiting a PR app...

Yes, you can be in Canada without status. Many people are. You can apply for this particular immigration class while out of status. Some people are applying for restoration of status. CBSA doesn't come kick the door in when your visa expires and put you on the next plane out. You don't just cease to exist once your visa expires.

Yeah the cafe stays open all winter usually.. except like -40 days when your bones ache just being outside.. Otherwise, we rock the grill. It's my stress relief..

Like I said, let them visit. They can see my bathroom is full of: potions, lotions, beauty and makeup gear. I have: a bottle of body wash, a razor, toothbrush and deoderant. The rest of the stuff that is around our bathroom is hers.. They can see our co-mingled laundry and closet. Her shoe collection, etc. He prized possession, her dog, is here. She walks both dogs through our neighbourhood on the regular. They'd be hard pressed to leave without a total sense of genuine.

That reminds me -- I should brew some beer and press some wine -- just in case ;)

That said, it's better to try to avoid it ;). Right??

The information I provided is correct. The OP should wait until OWP (there won't be much in GCMS before then) as they'd both will have status and they can save the time, frustration, and cash.

Sorry, didn't realize you were the expert after filing a total of one ATIP request.

My main point was that you don't need that consent form to ask for information about yourself. Would you like me to forward you my GCMS notes so you can see for yourself?

I'm currently out of status (applied for restoration) and I send my request for notes last month. Just in case, to see what happends. I thought that maybe I can qualify under "living in Canada" condition and there was no fee to be paid so no harm trying. I'll let you know how that goes when/if I receive my notes mid to late October .

Judging by MY shoes collection and all the crap in the bathroom they might end up thinking my husband is the one not living here :) :) :)
As you said, just a razor, deodorant and shower gel ( not even that, cause I convinced him to get some oatmeal organic one)... :P

Cool. Let's see how that goes. I feel like we have all been on this forum for a while but my notes didn't have much movement aside from the fact that all of the correspondence with CIC has been recorded and the info on my file is up to date.
It did have that SIR code and nice bold letters telling me that my application has been selected for the backlog reduction program so that is a good sign. However, still sitting here without AIP or anything. My notes took 31 days to arrive via email.
