hi 2016 folks
we just got off the phone with CIC asking about some workpermit issues.

We have also inquired about our sponsorship applications and what they have told that applications which are part of the backlog reduction pilot will be completed by the end of the year the latest!

therefore I expect to see lots of DMs in this thread in the coming months !!!!!!!!!!!!!!!!!!!!!!

Hello 758IG and CanadianAlien,

When checking your ECAS, what is the status of your PR application? was it still application received or in Process?

Thank you.

I never use ECAS all it says is application received.. I prefer my cic...

Hi All,

I have a query regarding 'implied status' for my wife, here is the scenario:

1) My wife is in canada with me on 'Visitor Visa' and as per rules she has to leave in 6 months.
2) I am PR, already applied her PR in Spousal Sponsorship in-land Applications category along with OWP.
3) I got AOR1 and AOR 2 for our application and file number, no news on OWP.

Does it give her implied status?
or we should get approval for both of us which would give her implied status , which I am sure that would come very close to when she would finish her 6 months duration in canada.

Does she has to leave canada before 6 months are completed to another country (few hours, days, weeks ..?)
or only to her origin country?
She has visitor visa longer till 2017 end, but I am not sure this will make any sense as she must leave before 6 months.
if she leaves and try to come back in few weeks, would Border officer create trouble while re-entering in Canada?

I think the time when CIC received your application file (mention in AOR1), if your wife has a valid visitor visa when CIC received application then for sure your wife has a implied status. As far as I know that's the rule no matter when you are going to receive your OWP. According to timeline you should receive it between 90 to 128 days.

She has her implied status from the time CIC received your inland application until the decision of PR came out. ( i'm assuming that cic received it before 6 months of stay of your wife). Means she is in legal status while waiting for final result on inland application.

"A temporary resident must apply to extend their period of authorized stay before it ends. If they have done so, their period of authorized stay as a temporary resident is extended by law until a decision is made [R183(5)]. Such a person is considered to have implied status as a temporary resident during that period."

It is not advisable to travel outside canada while on inland application. It's your call.

Thanks a lot pedropil, such a detail response!

Yes CIC received her PR application with in 6 months of her stay and we received Application File no as ell, However I always felt that 'implied status' comes as and when CIC gives approval.
It's not only applying for extension (work permit or PR etc...) gives you implied status but some sort of Acknowledgement/approval from CIC is necessary.

Else just think non-eligible candidates(due to any reason...) would just apply applications and would live in canada on implied status and then CIC would come back to them after certain months of rejection?

Great news! Thanks for sharing.

Our status on My CIC is now updated:

Review of Medical: Passed

I know it is just a baby step but I was so excited.

MY STATUS READS APPLICATION RECEIVED AND I HAVE AIP

Congrats!

Yes, most of them here applied for visitor visa extension after the CIC received their inland application and right before their visitor visa duration of stay expires. Just making sure that you still have legal status in case something wrong came up like that they will return your application. Especially if your stay expires, OWP permit cant be done right away, you to apply for restoration of status aside from inland application with OWP.

I'm in the same exact position as you .... Sent in my application on may 16th got my AOR1 on June 29 and I am yet to receive AIP or SA ,when I checked my account I saw background check in process.... so ...I called on Tuesday 2nd of August and the person I spoke with said that I am part of the 34k applicants ... I do not know exactly what is going on.. I haven't submitted my medical as yet either ... but I think I will in the upcoming weeks because I do not want to slow down the process...
Mine says in progress as well. I wonder if I'd be a part of this then too? Hmm. Does your application status say open on my CIC?? If not, what does it say? I would be beyond happy if I got this by the end of the year. Been in Canada for 10 years. It's not easy.

Hi Ringland,

So I think 'implied status' is confirmed and I won't apply for restoration of visa either which isn't needed then.

I wish you good luck, as Sep 08 is just a month far, hope you receive approval or OWP before that.
