So, guys, got my GCMS notes today.
Soooo boring, basically they were generated a day after my request, so nothing was started yet.

What I wanna say is:
1. My request was made under the Privacy Act, so I haven't paid any fee
2. I am currently out of status (with a restoration request pending), so I guess it's enough for someone to be living in Canada, not necessary have a valid status (or they don't check at all - I'm inclined to believe the 1st option, cause I also requested my notes for the TRV app and it was obvious I had no status, since I applied for restoration)
3. I got both PA and Sponsor notes without submiting any consent form; just used diferent info on each request (mine and my husband's)

I just received my GCMS notes and I'm a little confused (of course). Hope someone can help explain it a bit more.
I requested them on 09/19 and received them this morning so total of 29 days. It says security and criminal. First question, why is there two of these and what does it mean? How long does it usually take to complete? I've been at this stage since may. Still in process, no eligibility started yet. It also says "RCMP- no reported traces". Is that a good thing? lol I hope so because I'm clean as a whistle. These notes are so awesome and cool. Very detailed. I'm thinking I might do my medical soon since it's just a pass or not pass to make it easier for the process forward since I'm also part of the inventory for backlog, review required.
Last question, in the email it says this "You are entitled to submit a complaint to the Office of the Privacy Commissioner of Canada (OPC) regarding the processing of your request. For additional information on how to submit a complaint, visit the OPC website", what does this mean exactly?

3/ You must have submitted two requests. It was way easier to submit just one request, requesting all case details, for us. They haven't done any processing, that's why there will be little traces of his info in there (but I doubt anything significant).

2/ Are they proceeding to process? Here is what IP-8 says about lack of status (IP-8 pg 31 & 32):

"5.27 Lawful temporary resident status in Canada

Under the current Regulations, applicants in this spouse or common-law partner in Canada class must have a valid temporary resident status on the date of application and on the date they
receive permanent resident status to be eligible to become members of the class.

However, applicants who lack status as defined under the spousal public policy (see Appendix A) may be granted permanent residence so long as they meet all the other requirements of the
class, i.e., they are not inadmissible for reasons other than "lack of status".

Applicants who do not have temporary resident status and who cannot be granted positive consideration under the spousal public policy can be removed at any time. Further, the spousal
policy does not change the requirement to seek necessary authorization to visit Canada or to work or study here.

If the applicant cannot be exempted from the legal temporary resident status requirement under the spousal public policy (Appendix A) and request an exemption from the requirement to have
temporary resident status in Canada based on H&C consideration, please refer to Section 15.

What is “lack of status” under the public policy?

For the purposes of the spousal public policy (see Appendix A), persons with a “lack of status” refers to those in the following situations:
 - persons who have overstayed a visa, visitor record, work permit, study permit or temporary resident permit;
 - persons who have worked or studied without being authorized to do so as prescribed by the Act;
 - persons who have entered Canada without a visa or other document required by the Regulations;
- persons who have entered Canada without a valid passport or travel document (provided valid documents are acquired by the time CIC seeks to grant permanent residence);
 - persons who elude examination upon entry to Canada. In these cases, officers should assess the bona fides of the relationship. If it is deemed to be a relationship of convenience, the application should be refused. If the relationship is deemed bona fide, the application should not be refused on the grounds that the person did not present himself at the port of entry for examination upon entry.

Note: Lack of status may also refer to persons who have overstayed a temporary resident permit.

"Lack of status" for the purposes of the spousal public policy (Appendix A), does not refer to any other inadmissibilities including, but not limited to:
 - failure to obtain authorization to return to Canada, where required, after removal or after a removal order has been otherwise enforced;
 - persons who have entered Canada with a fraudulent or improperly obtained passport, travel document or visa and who have used the document for misrepresentation under IRPA. For greater certainty, persons will be excluded from being granted permanent residence under this public policy:
 - if they used a fraudulent or improperly obtained passport, travel document or visa to gain entry into Canada; and
 - if this document was not surrendered or seized upon arrival; and
 - if the applicant subsequently used these fraudulent or improperly obtained documents to acquire temporary or permanent resident status.

Other cases may be refused for misrepresentation if there is clear evidence of misrepresentation under IRPA, in accordance with the Department's guidelines.

See Appendix A for the full text of the spousal public policy. "

NRT beside RCMP is good -- means you have been a good person (well, no trouble with the law).

Criminality == Police.
Security == Much worse (that's where CSIS gets involved, to trace your steps in your home country. Looking for discarded cigarette butts etc).

The bit about the privacy office is to complain if they severed information that they shouldn't have.

Thanks so much! The security is for my home country so I'm not too worried because I was a child when I left so no trouble there haha Also, I noticed there is a fax # listed under my home number so I googled it because I don't remember ever writing one down on my application and it's some criminal law firm mass Tsang?? I have never heard of them before. Should I call IRCC and ask about this? I'm a little nervous now.

Security is to make sure you are not part of some crime syndicate, or terror group. I was teasing about tracing your steps -- maria_mirabela was worried they would sent a roving squad of CSIS agents into her home town ;)

You can send them a Case Specific Enquiry: https://secure.cic.gc.ca/enquiries-renseignements/canada-case-cas-eng.aspx . I wouldn't call them (and sit on hold forever) for such a minor detail.

The thing is I requested the notes same as legolg, on September 19 and they issued them the next day - I dunno why wait 30 days to send them, if they were generated; but anywayz, my AOR is Aug 9th so I didn't expect much activity on my notes just yet. Now that myCIC shows background in process, I will consider doing my medicals and submit em too, then request another set of notes (probably late Nov or so).

Good to hear they are proceeding anyway. That is what IP-8 states, that under public policy, as long as you are not inadmissible that they should still proceed. But also a good idea to fix status.

Yeah they sit on them for some time. If I was to guess, I would say that there is a staffer who pulls the notes, then they end up in a queue for a Privacy Custodian to clear them.

Sad to note that, it isn't worth ordering them in November for your case. I would do the medical, then wait until you have CIC acknowledging it before ordering more notes. You'll just get frustrated...

If you read through the docs you'll see that they do infosharing with the US. They tried to find you in the US system, and it was NRT (No Reportable Trace). Which is good (I guess? It won't affect anything being NRT).

inventory - SPR is interesting. I think it means they have placed your file into the inventory to return to it in a few months?

Oh I dunno about that' I wasn't expecting much info from these notes I got today, so I wouldn't expect from the Nov ones either. I think I should order them just in case they ask for something and I don't get the e-mail (there were A LOT of cases, so I've heard).

I think there is a balance between being proactive and pissing them off. Realistically, if they ask for something, it will be in myCIC. If you don't get notification, then you will find the email in there. But, at the same time, yes it's perfectly reasonable to ask for them every couple months to see what's going on... my $0.05 anyway. We don't want to piss them off enough that they decide we should have an interview...

Mhm... US? I've never been, never declared I was there and no intention to go in the near future....
On the other hand, I've visited more than 10 European countries and there's nothing on that.
