I see the others answered the other query. Ya drop the IRB claim asap.

If you had reasonable bona fide for your sponsorship file, then an IRB claim shouldn't have been made. It added additional pressure to an already overloaded system, and if the IRB file was heard and refused before your decision on sponsorship, then CIC would have refused the file based on Refugee rules... Did they advise you of that? That would have been a disaster :(

Not necessarily correct, you can have a refuge claim along with another application in process. Many people have done it. Also cic knows that cbsa has his passport and should request it on his behalf when passport request comes along. This is as far as I know, with ppl who have gone through that process. Having a refugee claim pending, and you started another application before the case is called, then you are fine. If you do have a failed claim, and then try to do another process, especially spousal, then it creates major red flags. I agree with you on the part of having AIP, go ahead and withdraw refugee claim.

What happens is the person submits a refugee claim and in the meantime life happens and then they meet someone and they get married. At that point the person should withdraw the claim and submit an application through the spousal process. Any person who is being paid to advise someone on this should have told the person this.

A lot of the times people get incorrect information from so called consultants who advise them erroneously to apply for refugee status because in the past the process to make a decision would take two years now IRCC has overhauled the refugee stream and it is the decision is much faster and people who have claimed refugee status find themselves being denied (because many of those who file do not meet the requirements ... escaping war, persecution, or natural disaster) so they throw their money away making a claim that will be denied. I cannot tell you how many times this happens.

If you have/had a claim in and you get married you need to cancel that first and submit an application for the second.

It has been determined that you meet the eligibility requirements to apply for permanent residence as a member of the spouse or common-law partner in Canada class. Please note that a final decision will not be made until all remaining requirements for becoming a permanent resident have been met. These requirements include medical, security and background checks for you and, if applicable, all of your family members, both in Canada and abroad, even if they are not applying to join you in Canada at this time. You cannot become a permanent resident until you and all your family members have met these requirements.



I wonder if they will require another medical. Because her medical expired April this year.
Anyways, we will do it again if they asked. Gosh still can't believe it. We are almost there. :)

This doesn't apply to ur case but some ppl who went thru this process said if you are in the 2 processes at once, and you get a denied refugee case, but already got aip for spousal, then its not enough. However most times they will make you stay until the spousal app is completed. But u need to report to cbsa once a month to do some sort of thing....cant remember what it is.....till you get your PR. If both is denied then most likely u will have to leave Canada. Just learned this today.

Congratulations on your AIP! I hope they will extend the validity on your medical, but if they don't, well it's few hundred $ more and your application will be approved!

Oh really? Hmm ive seen and know many ppl who did it and had no issues. Know 2 ppl personally actually. And it was all good. They did not with draw the claim and they got aip and landing and everything was ok. It did cause some grief and app took longer though

And what happens if they get denied sponsorship and loses the refugee because they with drew because of spousal. They will be back to zero

Once you have the COPR, you can take that (or your AIP letter) to the Service Ontario location. That's where you sign up for OHIP. Service Canada is where you get your SIN. Permanent SIN requires COPR

Should I fill it or should I just go there and ask them and fill up every needed paper, looks like there few questions it wont take more than 3 min to fill up.
BTW I have change my address in Ontario a year ago should put it in the section (where did you move from?) or don't act stupid and write where I came from before landing in Canada more than a 16 month ago.
