Sponsoring my wife - refugee claimant?

Hello everyone. My wife came to Canada 2 yrs ago as a refugee. She claim for refugee hearing shortly after. 2 months after she claims we met, start dating, and get married 3 months later. We submit sponsorship application 4 months later - September 2011 and start waiting. We didn't stop refugee case and she wait for both - refugee hearing and sponsorship. August 2012 CIC ask for medical check and more information. December 2012 Refugee board set date for hearing but it was postponed because of a health reasons. They set up new date for 08 of April 2013. She went to that hearing but claim has been rejected telling her she can appeal. Me and her refuse to appeal and now we don't know what to do. If anybody knows what to do please post here. Can she stays in Canada stateless and wait for sponsorship or have to leave?

What country is she from, and why did you refuse to appeal?

I believe she can stay in Canada until she receives a deportation order, and you guys can apply inland. But even if you guys go through sponsorship, it's going to be very difficult, because you guys got married just 5 months after you met, and of course, she was a refugee applicant. And if you apply inland, they will not allow you to appeal if they reject your sponsorship.

We apply inland. We are both from Romania. She has deportation order since the day she claim as a refugee. This is the law. Now she has 28 days(i believe) to leave Canada. We don't wont to appeal because we think if she goes back to Romania and they separate our family CIC can speed sponsorship application to reunite us as a family.

They won't expedite your application. It will sit in the same queue as everyone. In fact it's more likely to be scrutinized because she's a failed refugee claimant.

I am no lawyer but if the law permits you (since I know it has changed) than go ahead and apply. I married my husband 3 months after stating to date and like 5 after meeting him, was also a failed refugee but we submitted every single thing we had to prove our relationship is real and I'm landing next week! I was removed last may so in 11 months our whole sponsorship was aproved. I will always say it just goes on the evidence you submit to them. If your relationship is real you have nothing to worry about.

We are not afraid to be inspected closely, as our marriage is genuine. We live together, we hope soon we will have a child. I think if she goes back to Romania and apply again out of country, its going to be little faster because of the "application processing times" in CIC web site

She's right

I'm glad you're confident about your relationship - but make sure to include lots of proof anyway. Sometimes the VO makes decisions that really confuse all of us.

PS: We have a friend that's a Romanian refugee who is also expecting a baby

How often is good to send proofs? I sent just one time pictures, taxes, credit card statements, phone bills. Next week we are going to fill new tax return and I am thinking to send them. I just spoke with CIC and they told me our file is on the way from VEG to ETO, and when I ask when the file is suppose to be in ETO they told me: "in the next 6 months". So know I am confused. Where to send new proofs, etc. And why case will be on its way such a long period?

Hi Peter, have you received 1st stage approval? if yes I believe she cannot be removed. They will wait until she gets her PR
