Some final questions

Hi all. My wife (common-law) and I have very nearly finished our PR application and it will be ready to send off tomorrow. First off I would like to thank all the people on this forum who have been so helpful. I have not asked many questions directly, but the search function on these forums has been my main source of information during this entire process.

Anyways, we have a few questions before sending the application off.

Our situation is this. We are applying through Seoul, South Korea, as we have been living here for a very long time (wife 10 years, myself 7 years.) We are having some difficulty explaining her plans to re-establish herself for the following reasons:

We are leaving South Korea permanently in two months. We will be traveling to visit family and friends in both the US and Canada. Then we plan on returning to Canada and settling in an apartment. She has family members who are searching apartments and we plan on having one secured before leaving South Korea.

So my question is... Should my presence there be mentioned in her plans to re-establish? I realize that I am not supposed to be moving in, as I will technically be visiting her and not allowed to stay permanently until my PR status has been granted. If need be, I will go back to the US and stay with family while awaiting my PR decision. Should I mention that I plan on staying with her while my application is being processed? Is it OK to mention that I will be staying with her as a visitor while awaiting my PR decision? Or should we simply not mention my whereabouts at that time, as the question seems to be directed only towards her, as she is the sponsor?

Legally, am I allowed to do this? To apply in Seoul, go with my sponsor to Canada, and help her begin establishing herself there while awaiting my PR status?

Your plan should be fine but there are something you may need to think about it before you make the decision.

Since you're going to send you application to Seoul then who is going to receive/connect between you and immigration office? Although some people said the officer will send their requirement to you via email directly but I think it would be better if you have someone in Seoul for you.

Yes, you will stay with your wife by having visitor visa and I suggest you to apply it before sending your PR application because some people mentioned about they can't get visitor visa after they applying PR because they should wait outside Canada. The other thing is, if your visa is expired during the processing time, you may have to leave, unless you have a good reason to extend it and you can't just tell CIC " because you're waiting for PR" since you apply outland.

Anyway, I might mention the plan about visiting family but I wouldn't mention about moving to Canada before the processing done, but it just my opinion.

Yes, we have someone in South Korea who will be receiving and sending mail between the Canadian embassy in Seoul and my sponsor in Canada. We also realize that if I am required to have an interview that I will have to come back to Korea for that.

I understand I cannot extend a visitor visa for the express reason of waiting for my PR. In this case, I would have no problem simply leaving Canada and waiting in the US. What I am wondering is how much of this should be put on the answer to the question about my sponsor re-establishing herself in Canada?

Actually, a lot of people have extended their stay in Canada giving this as a reason while applying outland (myself included). It is almost never denied as long as you have proof of funds.
