My husbands refugee application was also denied. He got a departure order in January 2011 but because immigration had his passport he couldnt leave in the 30days. We finally got his passport in June 2011 so 6 months after the departure order...since he didnt leave in the 30days because we were waiting for immigration to give back his passport to travel does that mean he was deported? We never got anything saying that the departure order was now a deportation. Will the 6 months waiting for his passport have an affect on his ARC?? After reading all these posts about how long it takes to finish an ARC im getting worried...does the time start for the ARC when they recieve the PRA or only after the PRA is approved??? :(

When inmigration notify your PRRA is denied they give you 30 days to leave Canada, so my passport was on time they gave it to me at the airport they notified me a date to leave the country and I did it, however when I thought my sponsorship process almost done my visa office in Mexico is requesting me an ARC , I sent them all the documents showing I left Canada before the date they specified me but people say does not it matter because we made an appellation even if you leave the country voluntary, in Mexico processing time for ARC is 6 months, so it pass 3 months already from the date when visa office requested me ARC, I am so worried like you because I dont know if they will approved or not, only I can give you an advice, try to keep all your documents from the refugee process to prove your husband complied with everything show the flight ticket when you bought it , I sent them everything I hope it will help to approve my ARC.

they have not requested it yet....my application still only shows "application recieved" on ecas and have not heard anything since the first week of August...but when we went to guatemala in June, immigration officers gave us some papers and said my husband has to send them in with his ARC or he will not be allowed back to Canada.

so dont worry, I think its better send this ARC from the begining because it takes to much time, I was reading in this forum Visa Office request ARC when you pass all security backgrounds and medicals and when they think your marriage is genuine , almost in the end of your process, I hope my case going straight because we paid all the fees and everything is done only I am waiting for this ARC , so if you sent it from the begining you have chance to get your visa as soon as they finish your security and medicals, and maybe you will not wait too much time like me,
When I thought I will get my passport request they sent me request for ARC , so sad I did not about it.
now I have to wait for the arc approval.
but we can keep us post to know how is going our cases.

hey guys, i hope i can get your opinion on my situation... we applied for sponsor before my husband got denied refugee and before the prra was offered... now, 4 months after we submitted the prra, we got an appointment to see the office in feb, but, we also got a letter saying that they don't have the prra application, yet, i have proof that it was delivered on time, so we resent it. have any of you had this happen? if they misplaced the prra application they can't really say prra was denied right? we're so scared! we are 2 months short from a year since we applied for sponsorship, so we're hoping that gives us some sort of answer... but i'm still scared on what the appointment with the prra officer is for!

I think you have to wait for your appointment, and you can speak with the officer if they can allow your husband stay in Canada to finalize sponsorship process because you already submitted , I dont know exaclty buy maybe they can help you if you explain them your situation, they will search in CIC website if you application is in process if so maybe you dont have any problem .
Can you log in CIC with your client ID or not???

yes i can, and this is the 2nd interview we have with them... the first one was where the prra was offered, and at that point i left them a photocopy of all the sponsorship app, along with a copy of the website where is sponsor app says 'in process'... so maybe i'll just take a copy of the updated one? waiting is the worse game ever! thanx for your advice!

Im confused as to why people that voluntarily departed have to complete ano ARC. Below is what I obtained on CIC website. My husband also departed voluntarily and because he left on his own and bought his own tkt I'm assuming he will not need to complete ano ARC. Am I wrong?

Types of removal orders

There are three types of removal orders.

Look at the document you received from Citizenship and Immigration Canada or the Canada Border Services Agency before you left Canada. The form number will tell you the type of removal order.

1. Departure Order (form number IMM 5238)

a) If you received a Departure Order and

left Canada within the required 30 days and
verified your departure with a Canadian immigration officer at the port of exit
you do not need an ARC. You may return to Canada subject to normal examination at the port of entry.

b) If you left the country without verifying your departure, or more than 30 days after the Departure Order was issued, the Departure Order automatically becomes a Deportation Order and you need to apply for an ARC (see point 3 below).

2. Exclusion Order (form number IMM 1214B)

a) If you were issued an Exclusion Order and

12 months have passed since you left Canada and
you have a Certificate of Departure (IMM 0056B) showing the date you left Canada
you do not need an ARC. You may return to Canada subject to normal examination at the port of entry.

b) If you wish to return to Canada less than 12 months after the Exclusion Order was issued, or do not have a Certificate of Departure, you need to apply for an ARC.

3. Deportation Order (form number IMM 5238B)

If you have been the subject of a Deportation Order you will need to apply for an ARC.

Note: A Direction to Leave Canada (form number IMM1217B) is not a removal order. If you have been the subject of a Direction to Leave Canada, you do not need to apply for an ARC. You may return to Canada subject to normal examination at the port of entry.
