Is it possible to apply as common law partner from Pakistan if you do not have a valid marriage certificate??(My marriage is invalid in Pakistan)

I do not have a joint lease agreement with my husband because we lived with my sister-in-law last year. The lease was in my brother-in-law's name. If my brother-in-law provides us with a letter stating that we lived with him and paid him rent will that proof be good enough to prove our residence together?

Did you have utility bills with you and your spouse's names mailed to the same address? Did your and your spouse's bank mail you bank statements to the same address? Any of you have driver's licences that show this address?

No I do not have any of these documents.

Get this, and if you can, get a joint bank account.

Thing is I got married two years ago in Pakistan but we were living in U.A.E at that time. Due to financial instability we had to move to Pakistan. I submitted my application to sponsor my husband in March 2018, 13 months after we got married under Family Class Spouse. Since we did not sign our Nikkah nama in front of witnesses, our marriage has become invalid. We want to convert our application to common law because we submitted our application 13 months after getting married, we just need proof of cohabitation. I am in Pakistan now, I cannot get a joint account in U.A.E now but I do have a joint bank account with my husband here in Pakistan but the statement will reflect my address here in Lahore. I was living in U.A.E on an on arrival visa so I do not have any proof of address on any documents from U.A.E but I have provided CIC with my U.A.E address on a form submitted with my original application package last year. The only proof that I can get is the affidavit from my brother-in-law, do you think that would be good enough?

The bank account was opened in 2018 but I need to prove my cohabitation from 2017-2018. Would that be good enough?

All of the different proofs you put in your application have to together cover the 12 month period you're trying to prove. So if you say you lived together since January 2017, but opened the bank account in June 2017, that proof obviously only refers to the period from June 2017 onwards. So you need other things that will cover what's not covered by the bank account, in this example.

If you only have a letter from your brother in law and a joint account not even covering the full cohabitation period, it's going to be very difficult, if not impossible, to prove cohabitation. Letters help, but you need other stuff as well.

Why not just get married properly?

I'm not sure if you will be able to just change the category on the fly while being processed as a married couple. The instructions for officers from 2006 (https://www.canada.ca/content/dam/ircc/migration/ircc/english/resources/manuals/op/op02-eng.pdf, page 35) say that if a conjugal or common law couple marry, they should inform IRCC and their application should continue being processed as if they're married. But it doesn't say anything about the other way around.

The only thing I see that would apply to your situation is the following: Until further notice, applicants whose marital status changes following a refusal decision—for example, following the refusal of their conjugal-partner application the sponsor marries the applicant—should be counselled to reapply under the appropriate category— in the above example, FC1. Also on page 35. Meaning, once you get a refusal for your spousal application due to the marriage not being valid, you need to reapply, either after getting married and applying for the same category again, or as common law if you can prove it.

The newest instructions I found are from 2011 and can be seen here: https://www.canada.ca/content/dam/ircc/migration/ircc/english/resources/manuals/ip/ip02-eng.pdf and I didn't find this section on changes after a cursory look. You could go through it properly and see if it has anything like the 2006 one.

Please keep in mind I'm not sure if you can change the category to common law or not, I just did some quick research on it because I feel like I read somewhere before that it can't be done. Either way, your proof for common law isn't particularly strong, so you may be looking at having to reapply after getting married all the same.

What happens if your response to procedural fairness letter does not reach LVO during the deadline? My deadline is February 24. I dispatched my response on February 18, 2019 through FedEx but their flight has been delayed. Originally the documents would have reached London by February 21 but now they are saying that it will reach on February 25. Please help Im very worried.

London Visa Office has aksed for an interview. They have provided us with an option to have our interview held at London or wait 6-12 months for our interview in Islamabad Pakistan. if we decide to wait for our interview in Islamabad, how long will it take for them to provide us with an interview date?

I need some advice. I hired a lawyer based in Toronto back in January. However I was not satisfied with his services so I decided to terminate my contract with him. he was supposed to return some of the payment that I had made. I provided him with my Pakistan Visa Debit card # to process the refund. He says that he made the refund and he has provided me with his POS machine receipt as well but I have not received the money. Now he's saying that the refund was processed at his end and the money has been debited from his company's account so now its not his problem and that I should deal with it on my own with my bank. I dont understand what to do because its not a small amount. How do I get it back??

Did you ask your bank if a deposit was made to your account? I think there is a body in canada responsible for lawyers conduct u can report him to that's if you are in Canada.
