PGWP Spouses - Implied status

Hi all,

I'll be graduating very soon and my intention is to apply to PGWP. I'll be in implied status while waiting for a response. What about my partner? When does the spouse open work permit expires? considering I'm finishing the program of studies 4 months before the formal expiration of both visas. Can a spouse still use this 4-month gap when the other person is waiting for his/her PGWP? I understand that once the student gets his/her PGWP, the job this person is going to perform needs to be attached to a cat. 0 A or B, otherwise the spouse will not be granted with an open work permit. Do we have to apply for PGWP and visitor record at the same time?

Thanks :)

If your spouse has a work permit now, it's going to be valid till its expiry date, regardless of what status you are in.

If your spouse wants to apply for a new work permit after you receive your PGWP, you need to have a 0/A/B job

Hi there,

I am a student in Canada and my wife is living with me. My study permit and her open work permit both are going to expire on 31st December, 2019. I did my education in 2 years post-graduate program. After completion of my study, I have already applied online for PGWP on 30th August, 2019. According to IRCC website, PGWP processing time is approx 116 days(approx 3 months 15 days). So probably I will get my PGWP by mid of December 2019 and then she can apply for her work permit extension. So now my questions are:

1) If she already applied for her work permit extension and then her old work permit expires then can she work on implied status?

2) In worst case, If I don't get my work permit before her work permit expires then can she apply for visitor visa to restore her status and can she stay until they we get final decision on her application?

3) For visitor visa is it necessary to apply 30 days before expiration of work permit?

Please provide me some suggestions on this case.
Thanks in advance.

You need a skilled job and 3 payslips for her to qualify for an OWP.

1. Yes.

2. If you have the necessary documents for your job, she can apply for a work permit even if your PGWP hasn't been processed.

3. No.

I should apply for my spouse by creating her own account for work permit extension or I should apply for her from mine account as a sponsor like first time. I am seriously confused in between of that.

Hi everyone, I am hoping you can help me with this question. I finished my studies in March 2024, and I applied for a work permit on April 12; my wife already has work permit, but it expires at the end of December 2024. Can we apply for her extension without my work permit first?

Hi Everyone, I am a student and recently graduated meanwhile my wife got her SOWP Visa and will be joining me here since I have received my completion letter and am about to apply for PGWP. Since she got her Visa based on my study Visa, however, while entering my status will be under 'implied'. Will it impact my wife's entry into Canada?
Any response and help would be appreciated.
