The way I see it -->

When they ask:

Was a positive Labour Market Information Assessment (LMIA) issued for the job offer in Canada?

that is the part they check whether your job offer is valid or not...

The previous question was not if you have a valid job offer, but if you have a job offer, that is the exact wording of the question.

So I think you should put "yes", since you are working, and of course when later they ask about the LMIA for that job offer (to check if is valid), then "no".

That makes sense to me, that's what I answered as well
But there is a question where it asked you , what is the Noc in your workpermit ? So what did you put there .

As I mentioned before, it has a dropdown list ONLY with NOC codes, so there not room for anything else like N/A, Not Applicable etc...

I put my current occupation's NOC code, which was the one I used for the qualifying Canadian work experience

The original post just asked about the answers on those questions, has nothing to do with the 600 points.

Of course you will NOT get those 600, as per CIC a valid job offer requires an LMIA, even if you currently work on previously LMIA-exempt work permit.

But still, you have to answer those questions

That section is made for people with LMIA supported job offers!! Your WP doesn't have any NOC on it so you basically misrepresented yourself. You should answer NO for the first question!

So, you suggest when it asks:

"Do you have a job offer"?

and i have been working for the past 1.5 year, to say "No"?

Does this make sense to you?

Where do you see that this section is made for people with LMIA supported job offers?

Later on, it clearly asks for LMIA, but not at that point you mention

I totally agree with your point , the only confusion part was Workpermit Noc number .

Oh well..whatever. You should search for a definition of a qualifying job offer. You can leave it your way if it makes you feel better, it doesn't benefit you at all though.

It's not about making me feel better or not, someone asked and I provided my opinion!

You should just read what cic writes and asks, respond only to that.

Did it say "Do you have qualifying job offer"?

NO, and that is why later they ask whether your job required a work permit but no LMIA.

As for your prompt to find the definition of a qualifying job offer, I would say read again my previous post:

Of course you will NOT get those 600, as per CIC a valid job offer requires an LMIA, even if you currently work on previously LMIA-exempt work permit.

You should try to read the questions and not add whatever you feel like they mean, question was clear.

When someone has not only a job offer, but has been employed for quite some time, how can he say "No", when they ask about a job offer, not a valid/qualifying job offer?

I know that OWP do not have NOC on them, but they way they structrured the page, it makes more sense to put current NOC (since it's only dropdown menu) than saying "No" to the job offer

P.S The CRS in the end gave the appropriate points, and of course NOT the extra 600 for the qualifying job offer

1. Then IMHO you answered it wrong. The instructions state that for a job offer to be valid you require a LMIA.

Now the question would be, who is better? One with permanent, full-time job and ~400 pts, or one without job offer and ~450 pts?

Because LMIA exempt job offers are still accepted as VALID job offer if the exemption is based on two conditions:
1. International trade agreement such as NAFTA.
2. Federal provincial agreement.

Any other LMIA exemptions are not considered as valid exemptions for FSW job offer.
I have just enquired from my HR that my job is LIMA exempt based on International trades agreement.
But the sad part is even the HR do not know if I need LIMA assessment as this offer was based on LIMA exempt.
Its very painfull process for employer to redo the LIMA I guess. Don't what are my options !

Actually, I just recheked the new rules and apparently there ARE NO exceptions for LIMA exemption this time. The exemptions used to be valid under the old FSW system. Here's the link:

http://www.cic.gc.ca/english/immigrate/skilled/offer.asp

So please ignore my earlier post below.

Thank you for response ! I totally agree with your message, So the question is do I need to get a LIMA from my employer now? if so Iam in a contract position now and I dont think they will do it for me.
