Hi Experienced Gurus and respected forum members
I have a complicated question for the forum and unfortunately could not get answers from FAQs
1) My son was born in 2017 so my family size increased by one , so does this also apply to the previous years to calculate LICO .
2) I am a physician and I make about more than the LICO . For tax saving purposes , i am incorporated and show a small income through my medical corporation ,by which i fall into a lower income tax bracket . This is a tax saving measure. Would the total income of my medical corporation count towards the income shown to CRA .
3) My accountant is willing to refile my income from previous years as added dividend from corporation and pay more taxes to show a increased income if required . Would this be a hassle when I file for sponsorship of my parents ?

Yes, your current family size including parents must be used for all 3 previous tax years.
Income to meet LICO must be personal income only, as shown on line 150 on your tax return. Any income paid to a corporation would not be considered.

I assume it's technically possible, as long as the re-assessments for previous tax years are completely done by the time IRCC checks your income (assuming you win a lottery spot and submit an app).
Of course CRA may wonder why you are making all these changes, so you could be flagged by them for future taxes. Would talk more to your accountant about this. But from IRCC point of view I don't think they will care for your parents app.
If you refiled your tax, you will be in so much problems with the CRA and they may decide to audit you which will results in significant delay in getting the tax return for all of the 3 years. You may not have sufficient time and it is also not wise to play around with CRA and IRCC. Maybe starting to pay more this year onward to yourself and apply later

I'm not sure if this question has been asked before and I cannot find any clarification on the CIC website.
The website says that they "will review the submissions and remove duplicate entries".
My Brother and I are both PR holders living in Toronto for over 4 years and have our own independent families here. We would now like to have our parents here on PR and want to send in their applications for the 2018 Draw.
I would like to know what exactly counts as a 'Duplicate Entry'. Is it:-
1. ONE PR Holder, either my brother or myself, applying twice for his/her parents?
AND / OR
2. TWO Siblings (such as my brother and myself)... both individually applying for our parents?
In the 2nd case, do they count 2 entries for the same parents as a "Duplicate Entry"? Since they were applied by 2 separate PR holders and sponsor names?

IRCC is asking for parent/grandparents information this time, which was not asked last year, the objective of asking that information must be to remove duplicate submission for same person(s) being sponsored more than once as that increases the chance of this person and take away spots for others, so to be fairer to everyone it make sense to remove such entries, cause at the end in the event even if both are selected, only one of them gonna file the actual application. Hence, it makes more sense to submit the entry by person, who is more eligible in terms of income and would actually file the application later.
IRRC is now asking for name and DOB of every parent or grandparent that will be sponsored to avoid duplication as in this case

So by this understanding, would they likely cancel both duplicate entries, or just one of the names? What has been their policies in the past?

Thank you for the clarification. In case they do find duplicate entries, what action do they take? do they typically delete both applications or just one of them?
you never know, they might delete one or both, they have not explicitly stated what actions they will take but clearly mentioned not to submit more then one, I would just play safe.
They never disclose how they manage duplicates and I would not take any chance, do exactly what they said or else if they filter out we will also never know since it is supposed to be "random"
Good morning, could someone please give me advice regarding a family class appeal? My mother tried to sponsor my grandfather in 2016 but she was rejected because our family's income was below LICO. However, my father works as a contractor and was making more money but it did not show up on the personal returns since he did not pay himself a salary. My mother also was receiving stipend as a graduate student of nearly 40k a year, which would have resulted in our exceeding LICO. I am 21 and am unsure whether I would still be counted in the family income requirements now - I saw a case where that meant that I would not longer be counted. The year that LICO was not met - 2013 was under by 1500 $.
My grandfather is 82 and a widower - my grandmother died in 2014. He has been staying with us on visitor visa regularly and returning to visit India to get the visa renewed. My mother is an only child and any immediate relatives in the area are also in advanced ages and in little position to assist him in India. He is emotionally very close to my mother and our family and relies on us. While he can perform necessary tasks like shopping etc. he is weaker and we prefer to be there to monitor and assist him. He also owns a business property, has cash assets, and also a residential property in India, all of which could be liquidated.
We were hoping to appeal on H and C grounds but I'm not sure how that would work? Does that mean we file another application with H and C, or do we just submit an appeal relying on these circumstances? Additionally, is it possible to get an extension for the appeal date? I spoke to a lawyer who said that was possible but she did not seem very reliable.

hi guys, question about dependents.. my Brother in law is 24 single, FT student and financially dependent on MIL. is he also eligible?

- have been a full-time student on an ongoing basis since before the age of 22, and
- have depended on a parent's financial support since that time.
There is no more exception for being a full time student, that was removed a long time ago.
Since I assume he doesn't have a disability that makes him incapable of ever working, he is not a dependent so can't be included in his mother's application. He would need to apply to immigrate on his own.
