Hi,

I am a very confused in regards to the Parental sponsorship procedure, especially the applicants residency component.

Scenario:

I would like to sponsor my mom next year ( if I am lucky to be selected), but I am not sure if she will be able to reside with me in Canada while the sponsorship application is in process. We are from a visa exempt country, so she is able to see me quite often. (6 months) However, I am not sure if she can be sponsored while residing in Canada as a visitor...If yes, will she be able to leave and come back again while the application is still in process, or once we submit the sponsorship while she is here with me , she will have to wait in Canada until the final decision. If yes, how to keep in status? Extending her visitor status on the basis of a sponsorship? OR if we submit a sponsorship while she is at her home country, will she be able to come to visit me in Canada while the sponsorship application is in process?

I am so confused in regards to the applicant,s residency requirements...please help!

There is no inland sponsorship for parents. All applications are processed as outland. Your mother cannot live with you in Canada while the application is being processed. She cannot live here until she is a PR and having a PR application in progress does not entitle her to stay here. She can certainly visit while the application is being processed. If you want her to be able to stay for extended periods of time as a visitor, she should apply for a super visa.

I have heard from some friends that they know parents who were residing in Canada on a temporary status while their sponsorship application was in process. They were advised not to leave Canada while there application is in process, so they did not leave, and now they are all PRs. They have stayed in Canada on a temporary status for many years without going back to their home country. That's why I thought that there is an in-Canada and out-of Canada sponsorship same as for spouses. I would like to clarify that once I submit a sponsorship application for my mother, while she is in Canada, she will still be able to go back home and come back to Canada, or vice versa if we submit a sponsorship application while she is in her home country, she will be able to come to visit me here in Canada. I am looking forward to understand this component of the application so we can plan accordingly.

Also, I have a similar question regarding Super visa. If we extend my moms visitor status with visitor visa components, and she gets approved for 2 year stay, will she be able to leave an re-enter Canada on a basis of her visitor record valid for 2 years or it will be cancelled once she leaves Canada?

There's nothing that guarantees re-entry. Each re-entry will be treated as a new visit and it's up to the CBSA officer if and how long she is allowed back into Canada. Provided she is spending more time outside of Canada than inside of Canada - re-entry shouldn't be an issue.

Again, a super visa would allow a longer visit in one stint.
