Hi,

Hoping somebody can advise me of my options. I made my outland application which is being processed in London. I thought I would have heard back by now but London's processing time seems to have slowed up since I made my application in February.

My working visa is due to expire in a little less than a month. I got this visa through getting a LMO. The LMO approval was for three years but I just got half of it as the time due to my passport expiring in 1.5 years from the time of approval. This has made things awkward for me.

What are my options to continue working until my PR comes through. I have a baby on the way this month and need to maintain an income to support my Canadian wife/child so it's worrisome.. It may get approved in the meantime but I want to be prepared the eventuality that is doesn't come through on time which seems very possible.

If there is no way to extend your work permit lmo, then you can change your status to visitor and then extend it if is going to expire before you hear back about you PR.

If I switch to visitor, will that not prevent me for working? I don't think I understand. Thanks

Since `Implied Status' is not available for an Outland applicant, which would typically allow you to continue working with a pending Open Work Permit submitted with an Inland application, I suspect that you will need to have your employer go through the LMIA (formerly LMO) process again...but, have you renewed your passport yet?

Sit tight and wait for someone that will know for sure what your best option will be.

If your lmo is about to expire and you can't apply to have it extended, then you won't be able to work as a visitor.

Yes, I have a new 10 year passport now. Going through the LMIA sounds pretty onerous so I don't think they would like to go through that process again.

This is very sneaky but it might work:

Maybe you can apply for an extension of your work permit through paper (it takes longer than online), based on the previous LMO you had saying that you would like to get the rest of the 1.5 years that your LMO allowed now that you have a new passport. Apply around a week before your status expires. Then you will have implied status while they make the decision, which means that you'll be able to work until they probably refuse your application (I guess they will because nobody suggested that option even though you had a positive LMO), but that will give you around two months extra of legal work. Don't tell them I said this when you apply.
Maybe you will have heard something by then.

I was in the same situation. I applied online to get remaining time on my LMO work permit, it was approved no issues. It's not sneaky the CIC website states you can do it. I recommend applying ASAP so you don't even have to go into implied status.

Was your LMO in date? My passport got delayed coming through so I thought I couldn't go back for the remainder of my LMO work permit. I thought it only stayed active for like six months. Thanks!

My LMO was over 1.5 years old. I imagine the 6 months you refer to is for originally applying. It must be a common issue, NZ only issues 5 year passports so with a 3 year LMO that's a pretty high chance passport will expire before LMO.

I remember looking for info on this when I was applying so I will share what worked for me, although it was nothing too complex. I applied on line for an extension, and I made it very clear that all I was after was the remainder of my LMO, nothing more. I didn't even bother getting new offer letter from my work. I used a super old one from way back from when I was on a working holiday visa. My original work permit stated that it had only been issued until end of passport so I made sure this was really highlighted to them. Good luck, although I don't think you need it, if they bothered issue you a LMO they are going to give you a work permit for the full time.

I know I can only get my passport renewed when it has 1 year or less remaining(unless lost or stolen....), so no way around the problem.

Hi Kiwi! Thanks for your inout on this. Encouraged to hear that my application to extend can be successful on this. It makes sense that it should be to me as I was granted a three year visa and now have a passport with the correct amount of time remaining. Did you provide some sort of covering note then to explain what it was you wanted to achieve with your application? Thanks

Yeah, I think there was somewhere to upload a cover letter, I just wrote everything I wanted to in it.
